SUBJECT: Premium Pay Limitations for Employees Performing Emergency Work
Under my delegated authority to make determinations under 5 CFR 550.106, I have determined that the terrorist attacks on September 11, 2001, and their aftermath constitute an emergency posing a direct threat to life and property. Therefore, effective September 9, 2001 (the first day of the applicable pay period), employees performing work in connection with the emergency who would otherwise be subject to a biweekly limit on basic pay plus premium pay equal to the rate of basic pay for GS-15, step 10, will instead be subject to a GS-15, step 10, annual limit. These limits include locality pay and special salary rates. You will be notified when this authority ends.
Please note that the law does not provide an annual limit for law enforcement officers (LEOs), who will continue to be subject to a biweekly limit of $4,508.00.
