MEMORANDUM FOR BUREAU PERSONNEL OFFICERS

SUBJECT:      Premium Pay Limitations

This is to inform you of changes in the attached Office of Personnel Management (OPM) regulations on premium pay limitations. These changes, which were effective May 5, 2002, provide that:

  • The premium pay limitation will be increased for many employees.


  • In a given geographical location, the same premium pay limitation will apply to law enforcement officers (LEOs) and non-LEOs.


  • Agencies may apply an annual limitation in the case of employees who perform mission-critical work or work that is directly related to an emergency or its aftermath.


  • Even when an annual limitation is applied, certain payments, such as law enforcement availability pay and annual premium pay for administratively-uncontrollable overtime work (LEOs-only), will continue to be subject to a biweekly limitation.

Pending modification of the Department's policy, components may submit a request for a determination of an emergency or mission-critical situation to the Assistant Attorney General for Administration. Comments on the interim regulations may be sent by June 7, 2002 to:
