CortsAssistant Attorney General for Administration SUBJECT: Premium Pay Limitations for Employees Performing Emergency Work Under my delegated authority to make determinations under 5 CFR 550.106, I have determined that the onset of armed conflict on March 19, 2003, and the need to enhance counter-terrorism measures to deal with the increased threat constitute an emergency posing a direct threat to life and property. Therefore, effective March 9, 2003 (the first day of the applicable pay period), employees performing work in connection with the emergency who would otherwise be subject to a biweekly limit on basic pay plus premium pay equal to the rate of basic pay for GS-15, step 10, will instead be subject to a GS-15, step 10, annual limit. These limits include locality pay and special salary rates. You will be notified when this authority ends. Please note that the law does not provide an annual limit for law enforcement availability pay or annual premium pay for administratively uncontrollable overtime work (AUO pay).
