Denver-Based Janitorial Service Agrees to Pay Nearly $1 Million in Back Wages to 2,772 Workers in Six StatesDENVER -- Denver-based Omni Contracting Management, Inc. (“Omni”), along with ten related janitorial corporations and two individuals, has agreed to pay a total of $964,662.78 in back wages and interest to 2,772 employees in six states following a U.S. Department of Labor investigation. “We are committed to protecting workers’ overtime rights and ensuring that they receive all the wages they have earned,” said U.S. Secretary of Labor Elaine L. Chao. “We succeeded in recovering nearly one million dollars in back wages for these workers.” Omni provides janitorial services to major supermarkets and large discount stores in Colorado, Texas, New Mexico, Nevada, Minnesota and Arizona. The corporate defendants also have been assessed a total of $10,000 in civil money penalties by the department’s Wage and Hour Division for repeated overtime violations of the Fair Labor Standard’s Act (FLSA). Omni and the related firms also have agreed to entry of a consent judgment in the U.S. District of Colorado prohibiting future violations of the FLSA’s overtime provisions. The investigation, conducted by the department’s Denver Wage and Hour Division, determined that the defendants had violated the overtime provisions of the FLSA by failing to pay employees time and one-half for hours worked over 40 per week. The FLSA requires that covered employees be paid the minimum wage for all hours worked plus time and one-half their regular rate of pay for hours worked over 40 per week. Employers also must maintain accurate time and payroll records.
