U.S. Labor Department Recovers $80,960 in Back Wages for 11 Restaurant Workers in McAllen

SAN ANTONIO, TX -- The U.S. Department of Labor’s Wage and Hour Division announced that Crazy International Buffet, McAllen, Texas, has agreed to pay $80,960 in back wages after an investigation found that 11 current and former cooks were paid in violation of the Fair Labor Standards Act (FLSA).

The investigation, covering the period Dec. 20, 2003 to Feb. 20, 2005, determined that Golden May Inc., doing business as Crazy International Buffet, failed to pay the appropriate minimum wage and overtime pay to 11 cooks. The restaurant opened for business December 2003.

“Some of the cooks were being paid a salary which did not yield the required wages,” said Nicasio Flores, Wage and Hour district director in San Antonio. “This full-service restaurant employer also failed to keep accurate time and payroll records for employees.”

The FLSA requires employees be paid the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked over 40 per week. The law also requires employers to maintain accurate records of employees’ wages, hours and other conditions of employment.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers. Average days to resolve a complaint decreased in fiscal 2004 from 108 days to 92 days.
