ABSTRACT: Because the Office of Dispute Resolution underwrites the funding of most Alternative Dispute Resolution processes utilized by its litigators to attempt settlement of pending litigation, the Office keeps records of such expenditures, as reported monthly by the Executive Office for U.S. Attorneys and as reported by the litigating Divisions on a case by case basis.

PURPOSE: The system is maintained to permit review of expenditures for third-party neutral services. Since the determinations of whether to use dispute resolution in a particular lawsuit, and if so, which ADR provider to select, rests with the staff attorney assigned to that case, this system enables the Office of Dispute Resolution to monitor the cost and nature of the services that it is promoting.

ACCESS CONSTRAINTS: This information system consists of paper records submitted by the litigating components. These records are filed chronologically in the Office of Dispute Resolution, and are not included within any computer information system operated by the Office. The information is publicly available, upon request.

AGENCY PROGRAM: The information contained in these records supports the promotion of dispute resolution processes when appropriate as an alternative to litigation.

SOURCES OF DATA: All of the data contained in the system is provided from either monthly reports provided by the Executive Office for U.S. Attorneys (which has delegated authority to commit up to $8,000 per case for dispute resolution services) or case-by case reports when a request for dispute resolution services is made by one of the litigating divisions in Washington.
