Understand timing of the decision on contracting method

Because market research often includes consideration of what marketplace (or industry group) to solicit, the final choice of contracting vehicle is not--or should not be--made until after market research, but may be made before the PWS or SOO is complete (Step 4). This is in some contrast to more traditional methods of contracting in which the decision about contracting methodology is sometimes made even before the IST is formed. In such cases, there would be little opportunity to re-shape the strategy.

However, as a practical matter, some thought is typically given to the contracting approach prior to market research, not to tie the agency down to any given method, but to help in planning market research. However, we reiterate: the final decision as to contracting approach should not be made until after market research has been conducted. This offers an opportunity for contractors to share their views on the benefits of various approaches upfront during market research.

But some final considerations: Keep in mind that performance-based buys utilizing a SOO do not follow the typical course of more traditional procurements. The team will have to be very focused on the process of the chosen contracting method, as well as the timing and the limitations, because these types of buys are typically made on a very fast track and competitively: 90 days or less when "well championed."
