3.1 Delegation. The Director, Minerals Management Service, is delegated the Secretary=s authority under Section 503 of the Natural Gas Policy Act of 1978 (NGPA), Public Law 95-621, to make determinations for natural gas produced in the Outer Continental Shelf (OCS).
3.2 Categories of Natural Gas. Category determinations shall be made in accordance with Section 503(c) and related sections of the NGPA as applicable to the OCS. The natural gas categories subject to application by OCS lease operators include the following (the pertinent section of P.L. 95-621 is shown in parentheses):
A. New OCS leases (Section 102(c)).
B. Gas qualifying for new natural gas ceiling price (Section 102(d)).
C. High-cost natural gas (Section 107(c)).
D. Stripper-well natural gas (Section 108(b)).
