The General Services Administration established the Multiple Award Schedules (MAS) Advisory Panel in accordance with the provisions of the Federal Advisory Committee Act (FACA).

BACKGROUND:
The Federal Acquisition Service negotiates MAS program contracts for commerical products and services. These contracts are for five years. The federal government issues task and delivery orders against the MAS contracts. State and local governments can also utilize several of the MAS program contracts.

The Competitition in Contracting Act, (CICA) requires MAS contracts and orders to result in the lowest overall cost alternative. To meet this requirement, the goal of the MAS price negotiation is to obtain government prices that are comparable to the firm's "most favored commercial customer". The MAS contracting officer must also determine prior to award that the negotiated prices are fair and reasonable. After award, the contractor may for various reasons, reduct his prices to commercial customers. Based upon price redcution provisions of the negotiated government contract, the government may also be entitled to the reduced prices.

MAS PANEL GOALS AND OBJECTIVES:

The MAS Panel will provide independent advice and recommendations to GSA on pricing and price reduction provisions of the MAS program. The Panel will review the most favored customer provisions, price reduction policies and provisions, and current commercial pricing practices. The panel will determine what, if any, changes are required to these policies and provisions that will result in FAS being able to negotiate the lowest overall prices for federal customers. The MAS Panel will report to the Administrator, GSA.

MEETING SCHEDULE:

Friday, Septembe 19, 2008, is the last date the panel will accept oral presentations. See the Fall 2008 Federal Register Notice for guidance for the submission of written comments.
