Abstract: The EFAST system contains data captured from the Forms 5500 (Annual Report/Return of Employee Benefit Plan) and related attachments that were filed with the Department of Labor beginning with plan year 1999. Employee benefit plans are required to file Form 5500 each year (certain welfare benefit plans maintained by small employers do not need to file a Form 5500). The form captures information related to the operation of the plan.

Purpose: The data base was created to facilitate PWBA's disclosure and enforcement responsibilities under the Employee Retirement Income Security Act as well as for research activities. The data base is used to locate images of the Form 5500 filings and to create facsimiles of the filings to disclose the information in the filings to plan participants and others. In addition, information from these forms is used to determine whether the plans are operating according to the law and may be used for a variety of research projects.

Agency Program: The information captured by the form(s) is used to carry out the law as specified in the Employee Retirement Income Security Act of 1974 and Internal Revenue Code sections 6039D, 6047(e), 6057(b), and 6058(a). Plans are required to provide this information. It is used by the Department of Labor and the Internal Revenue Service to determine whether plans are operating according to the law.
