United States Trustees

The United States Trustee program in the Department of Justice enforces Federal bankruptcy laws, protects the bankruptcy system from fraud and abuse, and supervises the administration of bankruptcy cases. There were approximately 2.0 million bankruptcy cases filed in calendar year 2005.

Effective

This is the highest rating a program can achieve. Programs rated Effective set ambitious goals, achieve results, are well-managed and improve efficiency.
  • The US Trustees program has a clear purpose and addresses a specific need for the efficient, effective, and fair resolution of bankruptcy cases.
  • The Trustee program has long-term, outcome oriented goals, as well as annual performance targets. For example, the program monitors the percent of assets paid by bankrupt debtors to creditors.
  • There need to be regular, independent evaluations of the program to measure success in meeting program objectives.

About Improvement Plans

We are taking the following actions to improve the performance of the program:

  • Reviewing current performance goals to determine if they can be more aggressive.
  • Developing at least one performance measure to reflect new responsibilities assigned to the program in bankruptcy legislation enacted in 2005.
  • Developing a stronger capacity for independent evaluations, either by re-focusing internal resources or contracting for evaluations by outside entities.
