Abstract: | This document amends the rules of procedures established by Occupational Safety and Health Review Commission implementing the Equal Access to Justice Act (EAJ Act). Changes: raising the net worth ceilings for eligible parties; local government units may now be eligible for fee awards; position of the government that has to be substantially justified has been defined; restriction of the government to introduce during the fee proceeding additional evidence of substantial justificaton. Comments are requested. Effective date: February 23, 1987. |
