The Office of Labor-Management Standards ensures union democracy, transparency, and financial integrity.

Form LM-2

Every labor organization subject to the Labor-Management Reporting and Disclosure Act, as amended (LMRDA), the Civil Service Reform Act (CSRA), or the Foreign Service Act (FSA) must file a financial report, Form LM-2, LM-3, or LM-4, each year with the Office of Labor-Management Standards (OLMS) of the U.S. Department of Labor's Employment Standards Administration. The three forms vary in the level of financial details which must be reported. The filing requirements are determined by the total annual receipts of the union.

The Form LM-2 reporting requirements are as follows:

Every labor organization subject to the LMRDA, CSRA, or FSA with total annual receipts of $250,000 or more must file the Form LM-2 for the fiscal years beginning on or after July 1, 2004. The term "total annual receipts" means all financial receipts of the labor organization during its fiscal year, regardless of the source, including receipts of any special funds. Receipts of a trust in which the labor organization is interested should not be included in the total annual receipts of the labor organization when determining which form to file unless the trust is wholly owned, wholly controlled, and wholly financed by the labor organization.

Effective Date

The Form LM-2 as revised on October 9, 2003 became effective on July 1, 2004 , but will apply only to annual financial reports filed by unions for fiscal years beginning on or after the effective date.

Comments on the Beta Version of the Software for Form LM-2

On February 4, 2004, beta versions of the software for the Form LM-2 were made available for downloading and users were encouraged to download the software, examine its functions and features, and provide comments to OLMS. The AFL-CIO submitted comments on March 5, 2004 and OLMS provided a response on March 26, 2004.

Specifications for Importation of Financial Data

Labor organizations may choose to complete the Form LM-2 by two methods. Unions may complete the form manually by typing financial data directly into the form. In addition, the filing software will also permit unions that keep records electronically to transfer financial data from their accounting programs to the Form LM-2. For electronic transfer, the Department has provided technical specifications to assist unions in converting their financial data into a format supported by the software.

The Data Specifications Document (DSD) provides the specifications and guidance for developing formatted import files that can be imported or attached to the form.

The DSD will be used only by those unions that choose to create these import files. These data files may be imported directly into the form or imported into the form as attachments. Unions with large data files should import these files as attachments, rather then importing the data into the form. The attachment method significantly decreases the size, and enhances the manageability, of the form.
