The Grand Jury charges:
- At all times material to this indictment, the Paper, Allied-Industrial, Chemical
and Energy workers ("PACE"), Local 5-1250 (hereinafter referred to as the Union) was a labor organization in
an industry affecting commerce within the meaning of Sections 402(i) and 402(j) of Title 29, United States
Code.
- On or about March 31, 2003, in the Northern District of Ohio, Eastern Division,
and elsewhere, the defendant, JENNY D. NOAH, did make and cause to be made a false statement and representation
of material fact knowing it to be false and knowingly failed to disclose a material fact in a report and
document required to be filed by the Union with the Secretary of Labor pursuant to Section 431 of Title 29,
United States Code, that is, the annual financial report form LM3, signed by the defendant, JENNY D. NOAH, as
Financial Secretary Treasurer of the Union, which falsely reported that the defendant received $6,761.00 in
salary allowances and disbursements, when, in fact, the defendant, JENNY D. NOAH, received $7,261.00 in salary,
allowances and disbursements, and which failed to disclose that the defendant, JENNY D. NOAH, wrote an
unauthorized Union check for $500.00 as cash but which the defendant used for her own personal benefit.
All in violation of Title 29, United States Code, Section 439(b).
