U.S. Department of Labor debars Progressive Environmental LLC

Idaho reforestation contractor violated Service Contract Act

SEATTLE -- The U.S. Department of Labor has debarred Progressive Environmental LLC and owners Bruce Campbell and Randy Humbert of Coeur d’Alene, Idaho, following a Labor Department Administrative Law Judge Decision and Order finding violations of the McNamara O’Hara Service Contract Act (SCA). The company and owners are ineligible to receive federal contracts for a period of three years.

The department’s Wage and Hour Division determined that the company owed back wages to 73 employees as a result of its failure to pay prevailing wage, fringe benefits and holiday pay to reforestation workers as required under the SCA. The administrative law judge found the contractor and its owners had violated the SCA, as charged by the department, and that the employers had illegally deducted transportation costs from employees’ pay.

“The employees – who worked in tree planting, thinning, herbicide application and slashing brush – received earnings below the required prevailing wage,” said Donna Hart, director of the Wage and Hour Division’s Seattle District Office.

The SCA requires contractors and subcontractors performing services on federal contracts in excess of $2,500 to pay service employees no less than the wage rates and fringe benefits found prevailing in the locality.
