Owner of Manhattan and Bronx Self-Storage Facilities Pays Employees $95,000 in Overtime Following U.S. Labor Department Investigation

NEW YORK -- Tuck-It-Away Associates L.P., the operator of Tuck-It-Away self-storage facilities in Manhattan and the Bronx, has paid 24 employees over $95,000 in overtime back wages following a U.S. Department of Labor investigation into alleged violations of the federal Fair Labor Standards Act (FLSA).

“In this case,” said Philip Jacobson, New York City district director for the Labor Department’s Wage and Hour Division, “our investigation found that the employer considered 24 site managers to be exempt from the overtime provisions of the FLSA. However, the investigation found that these employees were not performing exempt duties. Consequently, they were owed back wages for the overtime they had worked.”

Jacobson noted that the workers due back wages were employed at nine of the 11 Tuck-It-Away locations around Manhattan and the Bronx. In total, the company agreed to pay them overtime back wages of $95,447.

The FLSA requires that employees be paid at least the applicable minimum wage and time and one-half their regular rate of pay for hours worked more than 40 per week. It also requires employers to keep accurate records of employees’ wages, hours, and other conditions of employment, which the company also failed to do in this case.

Jacobson stressed that the company cooperated fully with his office during the investigation.
