New Milford, Conn. Employer Agrees to Pay Employees $17,000 in Overtime

Settles U.S. Labor Department Lawsuit

BOSTON -- M and O Construction Co. Inc. and owner Melvin McBreairty, both of New Milford, Conn., have agreed to pay eight employees a total of $17,000 in overtime back wages to settle a lawsuit filed by the U.S. Department of Labor alleging violations of the Fair Labor Standards Act (FLSA).

The lawsuit, filed a year ago in the U.S. District Court for the District of Connecticut, alleged that the construction contracting company and its owner violated the overtime and recordkeeping provisions of the FLSA between Aug. 4, 2002 and Aug. 7, 2004. The FLSA requires that covered employees be paid at least the applicable minimum wage and one and one-half times their regular rate of pay for hours worked over 40 per week. The law also requires that accurate records of employees’ wages, hours and other conditions of employment be maintained.

A consent judgment prohibits the defendants from future violations of the overtime and recordkeeping requirements of the FLSA, and orders them to pay employees the back wages on or before Sept. 30, 2006.

The Labor Department’s Wage and Hour Division office in Hartford, investigated this case. The lawsuit was filed by the department’s regional office of the Solicitor of Labor in Boston.
