U.S. Labor Department Recovers Over $120,000 for 52 Employees of Pineville, N.C., Company

CHARLOTTE, N.C. -- Cam-Ful Industries Inc. has paid over $120,000 in back overtime wages to 52 employees after a U.S. Department of Labor investigation found that the workers had not been properly paid as required by the Fair Labor Standards Act (FLSA).

“The Wage and Hour Division is committed to ensuring that employees receive wages they have earned,” said John Blaine, district director of the department’s Wage and Hour Division in Charlotte. “In this case, $123,577 was recovered in back overtime wages for these salaried and hourly employees.”

The investigation, covering the period from February 2003 to February 2005, determined that salaried employees were misclassified as exempt from the FLSA overtime requirement and hourly employees were not paid proper overtime for hours worked over 40 in a single week.

The company cooperated fully during the investigation and agreed to comply with the FLSA in the future. Cam-Ful Industries installs heating, air-conditioning, plumbing and fire protection systems for large commercial and industrial projects.

The FLSA requires that covered workers be paid one-and-one half times their regular rate of pay for all hours worked over 40 in a single work week. Employers must pay at least the federal minimum wage and maintain accurate records of employees’ wages, hours and other conditions of employment.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year (FY) 2004 for more than 288,000 workers. Average days to resolve a complaint decreased in FY 2004 from 108 days to 92 days.
