Atlanta Temporary Help Company Agrees to Pay More Than $164,000 for 184 Employees Following U.S. Labor Department Investigation

ATLANTA --

The U.S. Labor Department announced today that Callaway Partners, an Atlanta professional temporary help firm, has agreed to pay $164,061 in back wages to 184 workers after a Wage and Hour Division investigation found they had not been paid in accordance with the provisions of the Fair Labor Standards Act (FLSA).

“The department is committed to ensuring that all workers receive the wages they have earned,” said Alfred B. Robinson, acting administrator of the Wage and Hour Division. “We are pleased to have recovered more than $164,000 for these workers.”

Wage and Hour investigators found that the company failed to pay non-exempt accountants overtime wages for hours worked more than 40 in a workweek. Also, otherwise exempt employees were found to have had inadvertent deductions, such as pay for holidays not worked, made from their guaranteed salary.

The company cooperated with the department, agreed to pay the back wages and comply with the law in the future.

Generally, the FLSA requires that covered workers be paid at least the federal minimum wage for all hours worked and time and one-half their regular rate of pay, including commissions, for all hours worked more than 40 in a single work week, unless otherwise exempt. The law also requires employers to maintain accurate records of employees’ wages, hours and other conditions of employment.
