U.S. Labor Department Recovers Over $143,000 in Back Wages for 110 Employees of Miami Design and Construction Companies

MIAMI -- The common owner of Telesco Associates and TGC Construction has agreed to pay $143,107 in back overtime wages to 110 employees after the U.S. Labor Department’s Wage and Hour Division determined the companies violated the Fair Labor Standards Act (FLSA).

“The owner of these two companies failed to pay hourly construction workers an overtime rate when they worked more than 40 hours in a week,” said Will Garnitz, district director for the Miami Wage and Hour Division. “These employees often worked more than 60 hours a week.”

An investigation by the department’s Wage and Hour Division determined that, between January 2004 and June 2005, Telesco Associates, a night club design company, and TGC Construction, a construction firm, failed to properly pay overtime wages due.

The overtime provisions of the FLSA require employers to pay covered non-exempt workers one-and-one-half times their regular rate of pay for all hours worked over 40 in a single work week.

The Wage and Hour Division recovered more than $200 million in back wages in fiscal year 2004 for more than 288,000 workers. Average days to resolve a complaint during that time decreased from 108 to 92 days.
