U.S. Labor Department Sues Aurora Employer of Indonesian Nanny to Recover a Total of $125,000 In Back Wages and Liquidated Damages

DENVER -- The U.S. Department of Labor has filed a lawsuit in federal district court against the Aurora, Colo., employers of an Indonesian nanny for alleged violations of federal minimum wage and recordkeeping violations of the federal Fair Labor Standards Act (FLSA).

The department’s lawsuit, filed Dec. 5, alleges that Homaiden Al-Turki and Sara Khonaizen, his wife, failed to pay Sitzulaikah Warsito Alib approximately $62,500 in minimum wages from Nov. 2002 to Nov. 2004. The defendants also failed to maintain adequate and accurate records of wages, hours and other conditions of employment.

“The Department of Labor is committed to ensuring that workers, especially low-wage workers, are paid all the wages to which they are entitled under the law,” said Richard Habura, district director of the department’s Wage and Hour Division in Denver. “Cases involving alleged servitude are the most egregious of cases, and the Department of Labor will do everything in its power, to the fullest extent of the law, to assure these employees get the wages they have earned.”

The complaint asks the court to order payment of $62,500 in unpaid minimum wages plus an equal amount in liquidated damages for total compensation of $125,000. The complaint further seeks a permanent injunction prohibiting the defendants from violating the FLSA in the future and interest on the unpaid wages and liquidated damages.

The FLSA requires that employers pay employees at least the applicable minimum wage and time and one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate records of employees’ wages, hours and other conditions of employment.
