Des Moines-area contractor pays more than $230,000 in back wages to 128 employees following U.S. Labor Department investigation

DES MOINES -- The U.S. Department of Labor’s Wage and Hour Division has recovered $230,190 in back wages for 128 employees of Nuckolls Concrete Services Inc. in Des Moines, Iowa. The employees of the concrete paving contractor worked on the I-235 reconstruction project in Des Moines from July 2004 to May 2006.

An investigation by the Wage and Hour Division found Nuckolls in violation of the Davis Bacon and Related Acts (DBRA) by making excess contributions to a training fund. The contributions, up to $6.80 per hour, were found to be in excess of what was required to provide the training and were considered back wages due the affected employees.

“The Department of Labor is committed to enforcing the law, ensuring that employees receive the wages that they are legally entitled,” said Percella Maupins, director of the Wage and Hour Division’s district office in Des Moines.

Nuckolls Concrete Services Inc. agreed to future compliance with the DBRA along with paying the computed amount of back wages.

DBRA requires that every federal contract for the construction, alteration or repair of public buildings or public works in excess of $2,000 contain a clause setting forth the prevailing wages and fringe benefits to be paid to laborers and mechanics employed under the contract. Contractors and subcontractors are required to pay workers locally prevailing wages and fringe benefits, as determined by the Department of Labor.
