U.S. Labor Department Recovers $48,363 in Back Pay for 272 Dayton, Ohio, Workers

CINCINNATI, OH --

A Dayton, Ohio, nursing home has paid $48,363 in back wages to 272 workers following an investigation of overtime pay practices by the U.S. Department of Labor’s Wage and Hour Division.

The Franciscan at St. Leonard owed the wages to employees because the nursing home failed to include attendance bonuses, weekend differential pay, and other incentive bonuses in the regular pay rate for purposes of calculating the half-time premium due when hours over 40 were worked in a single week. These violations of the Fair Labor Standards Act (FLSA) occurred between February 2003 and March 2005.

“The Department of Labor is committed to enforcing the law and ensuring that employees receive all wages they are owed,” said George Victory, district director of the department’s Wage and Hour Division in Columbus, Ohio.

The FLSA requires covered employees to be paid the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers.
