U.S. Labor Department Files Lawsuit Against Westerville, Ohio, Mortgage Loan CompanyCOLUMBUS, Ohio -- “The FLSA requires payment of minimum wage and overtime pay to employees the company classified as loan officers and assistant managers,” said George Victory, district director of the Wage and Hour Division in Columbus. “We will not hesitate to pursue litigation to recover back wages for employees when an employer refuses to make restitution for violations of the law.” An investigation by the department’s Wage and Hour Division found that the mortgage loan company employed loan officers and assistant managers who did not earn the minimum wage in some weeks. Workers did not receive overtime pay when they worked more than 40 hours per week. The investigation also found that the firm failed to keep an accurate record of hours worked by employees. The violations occurred since April 2002. American Elite Financial has offices in Westerville and Columbus, Ohio. The company has branch offices in Southgate, Okemos, Monroe, and Livonia, Mich. The FLSA requires that covered employees be paid the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked in excess of 40 per week. The FLSA also requires employers to maintain accurate time and payroll records.
