Permanent Labor Certification Program
A Permanent Labor Certification issued by Department of Labor allows a domestic employer to hire a foreign worker to work permanently in the U.S. The program, as administered, certifies that no qualified U.S. worker is available and that hiring the foreign worker will not adversely affect U.S. wages or working conditions.

We are taking the following actions to improve the performance of the program:
- Developing appropriate performance measures for the new program, and establishing ambitious long-term and annual targets.
- Revising the application for Permanent Labor Certification (ETA 9089) to promote clarity and ease of use by employers, address implementation of the Fraud Rule, and promote efficient processing.
- Revising the PERM electronic system to reflect changes to the application for Permanent Labor Certification (ETA 9089) and provide system enhancements to promote program integrity.
