TWO MEN SENTENCED ON OXYCODONE CHARGES

R. Alexander Acosta, United States Attorney for the Southern District of Florida, Jonathan I. Solomon, Special Agent in Charge, Federal Bureau of Investigation, Douglas Colon, Special Agent in Charge, Atlanta Region, U.S. Department of Labor, Office of Inspector General, Office of Labor Racketeering and Fraud Investigations, and Al Lamberti, Sheriff, Broward County Sheriff’s Office, announce that defendants James Modica, 60, of Tamarac, and David William Brock,44, of Boston, were sentenced today to 235 months’ and 168 months’ imprisonment, respectively, by United States District Court Judge James I. Cohn in Fort Lauderdale, Florida. The defendants had pled guilty on January 24, 2008, to conspiracy to possess oxycodone with intent to distribute, in violation of Title 21, United States Code, Section 846.

According to the court records, from about January 2005 to the date of Indictment, James Modica led an oxycodone distribution ring. Modica and other co-conspirators recruited others to visit various doctors’ offices in South Florida for the purpose of obtaining prescriptions for oxycodone and other controlled substances. Modica advised co-conspirators on what they needed to say to the doctors to obtain prescriptions for the largest amount of oxycodone. Modica provided money to co-conspirators to pay medical examination fees and the costs of the prescriptions. The defendants would go to several doctors each month to obtain prescriptions for as many controlled substance pills as possible. Modica distributed the oxycodone and other controlled substances outside the State of Florida, including to co-defendant David Brock in Massachusetts.

Mr. Acosta commended the investigative efforts of the Federal Bureau of Investigation, the U.S. Department of Labor, Office of Inspector General, Office of Labor Racketeering and Fraud Investigations, and the Broward Sheriff’s Office assigned to this case. The case is being prosecuted by Assistant United States Attorneys Jeffrey N. Kaplan and Paul Schwartz.
