ALIEN INDICTED BY FEDERAL GRAND JURY

FOR IMMEDIATE RELEASE

LUIZ ANTONIO NASCIMENTO, a/k/a/ Paulo Nascimento, age 46, a resident of Brazil, was charged in a one-count indictment by a Federal Grand Jury for illegal re-entry by an alien previously deported, announced U. S. Attorney Jim Letten.

According to court documents, on March 26, 2008, LUIZ ANTONIO NASCIMENTO, an alien who had previously been removed and deported twice from the United States, was knowingly and unlawfully found in the United States within the Eastern District of Louisiana, without have applied to the Attorney General of the United States or his designated successor, the Secretary of the Department of Homeland Security for re-admission to the United States.

If convicted, faces a maximum term of imprisonment of ten (10) years, a fine of $250,000.00 and three years of supervised release following any term of imprisonment.

U. S. Attorney Jim Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by Immigration and Customs Enforcement. The prosecution is being handled by Assistant U. S. Attorney W. Scott Laragy.
