NEW ORLEANS MAN SENTENCED TO 18 MONTHS IN FEDERAL PRISON FOR GUN VIOLATION

FOR IMMEDIATE RELEASE

DERRELL BRIGNAC, 24, a resident of New Orleans, Louisiana was sentenced by U. S. District Judge Ivan L.R. Lemelle to eighteen (18) months imprisonment for possessing a firearm as a convicted felon, announced U. S Attorney Jim Letten. In addition to the term of imprisonment, Judge Lemelle imposed three (3) years of supervised release following the term of imprisonment. During the supervised release term the defendant will be under federal supervision and risks an additional term of imprisonment should he violate any terms of his supervised release.

According to the factual basis, on or about March 29, 2007, New Orleans Police Officers conducted a traffic stop of a vehicle driven by defendant DERRELL BRIGNAC near the intersection of General Meyer Avenue and Michael Street. Further investigation revealed that BRIGNAC had outstanding warrants. Upon being advised that he was under arrest, BRIGNAC fled the scene in his automobile. He later abandoned his vehicle and attempted to hide in a residence where officers subsequently located BRIGNAC underneath a bed in the house. During the incident, BRIGNAC’s had in possession a Smith & Wesson, .40 caliber semi-automatic pistol.

The Court imposed a sentence withing the recommended guidelines range. After sentencing, BRIGNAC was remanded to the custody of the United States Marshal’s Service to begin his term of imprisonment

This case was investigated by Special Agents of the Bureau of Alcohol, Tobacco, Firearms and Explosives along with the officers of the New Orleans Police Department. The case was prosecuted by Assistant United States Attorney Richard W. Rose pursuant to the Department of Justice’s Project Safe Neighborhoods program.
