FEDERAL CHARGES FILED IN KANSAS CITY, KAN. BANK ROBBERY

Other federal grand jury indictments: drug trafficking, firearms violations, escape from custody

KANSAS CITY, KAN. – Richard D. Burk, 47, Kansas City, Mo., is charged with one count of bank robbery. According to the indictment, on Sept. 17, 2007, he robbed the First State Bank, 650 Kansas Avenue, Kansas City, Kan.

Burk was charged initially in a criminal complaint filed Sept. 26 that stated he gave the teller a personal check with a note on the back demanding money. The note read: “Robbery. ARMED. 100s, 50s, 20s. Warning: Don’t scream, don’t refuse. Now!”

Acting on a tip, police in Kansas City, Mo., arrested Burk the day after the robbery.

If convicted, he faces a maximum penalty of 20 years in federal prison and a fine up to $250,000. The Kansas City, Mo., Police Department and the Federal Bureau of Investigation worked on the case. Assistant U.S. Attorney Tris Hunt is prosecuting.

OTHER INDICTMENTS



A federal grand jury meeting in Kansas City, Kan., this week also returned the following indictments:

Shawn Clinkenbeard, 37, and Jason Roller, 37, are charged with one count of attempting to manufacture methamphetamine and one count of possession of pseudoephedrine with intent to manufacture methamphetamine. The crimes are alleged to have occurred Sept. 14 and Sept. 15, 2008, in Wyandotte County, Kan.

If convicted, they face a penalty of not less than 10 years and not more than life and a fine up to $4 million on the manufacturing charge. The Drug Enforcement Administration investigated. Assistant U.S. Attorney Scott Rask is prosecuting.

Enrique Torres-Sanchez, 30, Kansas City, Kan., and Ricardo Escoto, 22, Kansas City, Kan., are charged with one count of conspiracy to distribute and possess with intent to distribute methamphetamine and one count of distributing methamphetamine. In addition, Torres-Sanchez is charged with four counts of distributing methamphetamine, and Escoto is charged with two counts of distributing methamphetamine. The crimes are alleged to have occurred during April through Sept. 17, 2008, in Johnson County, Kan., and Kansas City, Kan.

If convicted, they face a penalty of not less than 10 years and not more than life and a fine up to $4 million on the conspiracy charge, and not less than 5 years and not more than 40 years and a fine up to $2 million on each of the distribution charges. The Drug Enforcement Administration investigated. Special Assistant U.S. Attorney Trent Krug is prosecuting.

Darius Freeman, 19, is charged with one count of unlawful possession of a firearm after a felony conviction. According to the indictment, the firearm was a 7.62 x . 39 caliber assault rifle. The crime is alleged to have occurred Sept. 15, 2008, in Wyandotte County, Kan.

If convicted, he faces a maximum penalty of 10 years in federal prison and a fine up to $250,0000. The Bureau of Alcohol, Tobacco, Firearms and Explosives investigated. Assistant U.S. Attorney Terra Morehead is prosecuting.

Michael Walters, 31, is charged with escaping from federal custody. According to the indictment, he escaped from the Grossman Community Corrections Center in Leavenworth, Kan. The crime is alleged to have occurred Sept. 23, 2008.

If convicted, he faces a maximum penalty of 5 years in federal prison and a fine up to $250,000. The U.S. Marshals Service investigated. Assistant U.S. Attorney Scott Rask is prosecuting.


As in any criminal case, a person is presumed innocent until and unless proven guilty. The indictments filed merely contain allegations of criminal conduct.
