ILLEGAL ALIEN SENTENCED FOR POSSESSION OF METH AND RIFLE

LOUISVILLE, KY - Fernado Ortiz, age 28, of Louisville, Kentucky, in Jefferson County, was sentenced to 8 years and 1 month imprisonment in United States District Court, Louisville, Kentucky, for possession of more than 5 grams of methamphetamine for the purpose of distribution, and possession of a firearm by an illegal alien, U.S. Attorney David L. Huber of the Western District of Kentucky announced today. Joseph H. McKinley, Jr., Judge, United States District Court, also sentenced Ortiz to 4 years supervised release following incarceration. There is no parole in the federal judicial system.
Ortiz had plead guilty on March 3, 2008, to possessing more than 94 grams of a substance containing methamphetamine with the intent of distributing it. Ortiz also admitted that he possessed an AR-15 assault rifle which was a criminal offense as a result of his status as an illegal alien. Ortiz also possessed five magazines together with fifty-nine rounds of ammunition. The street value of the methamphetamine is approximately $4,000. The methamphetamine and rifle were found when Louisville Metro police responded to an allegation that Ortiz had committed a sexual assault.
The case was prosecuted by Assistant United States Attorney John E. Kuhn, Jr., and it was investigated by the Drug Enforcement Administration and the Louisville Metro Police Department.
