OAKLAND MAN SENTENCED TO 13 YEARS IN FEDERAL PRISON FOR POSSESSION OF CRACK COCAINE AND A FIREARM

OAKLAND – United States Attorney Joseph P. Russoniello announced that Kenneth Eugene Holloway, 41, was sentenced this week to13 years in prison for possessing 5.6 grams of crack cocaine with intent to distribute them and for possessing a firearm in furtherance of that drug trafficking crime.  This sentence is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Oakland Police Department.

Holloway was indicted by a federal grand jury on May 31, 2007, and he  pleaded guilty on January 30, 2008, to possessing 5.6 grams of crack cocaine with intent to distribute them (in violation of Title 21, United States Code, Section 841)  and to possessing a firearm during and in furtherance of that drug trafficking crime (in violation of Title 18, United States Code, Section 924(c).  In his Plea Agreement, Holloway admitted that on August 25, 2006, he fled from Oakland Police.  After Oakland Police caught Holloway, they found the crack cocaine and the loaded firearm in his car.  According to court documents, a few months later, in November 2006, Holloway committed an armed robbery of a jewelry store in El Cerrito.  Holloway has pleaded guilty in that case and will be sentenced later this month in Contra Costa County Superior Court.

Also according to court documents, in 1982, when Holloway was 15 years old, Holloway robbed a 23-year old UC-Berkeley student in Berkeley, and then he murdered her after she disobeyed his directions not to turn around and look at him.  Holloway netted 75 cents from that robbery.   

In addition to sentencing Holloway to 13 years in prison followed by 5 years of supervised release, Judge Wilken ordered that while Holloway is on supervised release, law enforcement officials may search him at any time without a warrant and with or without cause.

Holloway has been in custody since his arrest on March 30, 2007.
