OVERVIEW

Certain equal employment opportunity (EEO) and nondiscrimination laws enforced by the Department of Labor (DOL) prohibit discrimination and require covered employers and grant recipients to ensure that employees and grant program beneficiaries receive equal opportunity regardless of race, color, religion, sex, age, political affiliation or belief, national origin, and status as a United States citzen, an individual with a disability or a protected veteran. DOL's Office of the Assistant Secretary for Administration and Management's Civil Rights Center (CRC) oversees the equal opportunity laws covering programs and activities receiving federal financial assistance from the Department.

Discrimination is prohibited in provision of benefits and services and in such employment practices as recruitment, rates of pay, upgrading, demotion, transfer, layoff, promotion, and selection for training. Employers may not make distinctions based on race, color, religion, sex, or national origin in wages, hours, job classifications, seniority, retirement ages, or job fringe benefits such as employer contributions to company pension or insurance plans. DOL grant recipients must administer programs in a nondiscriminatory manner in accordance with specific civil rights laws. Sexual harassment is a form of discrimination on the basis of sex.

APPLICABLE LAWS AND REGULATIONS

  • Title VI of the Civil Rights Act of 1964, as amended - Prohibits exclusion from participation in, denial of benefits of, and discrimination under federally assisted programs on the grounds of race, color, or national origin.
  • 29 CFR Part 31 - Regulations regarding nondiscrimination in federally assisted programs of the Department of Labor under Title VI of the Civil Rights Act of 1964.
  • Section 504 of the Rehabilitation Act of 1973, as amended - Prohibits exclusion from participation in, denial of benefits of, and discrimination under federally assisted programs on the grounds of disability.
  • 29 CFR Part 33 - Regulations regarding nondiscrimination on the basis of disability in programs and activities receiving or benefiting from federal assistance under Section 504 of the Rehabilitation Act of 1973.
  • Age Discrimination Act of 1975, as amended - Prohibits discrimination on the basis of age in programs or activities receiving federal financial assistance.
  • 29 CFR Part 35 - Regulations regarding the nondiscrimination on the basis of age in programs or activities receiving federal financial assistance from the Department of Labor.
  • Section 188 of the Workforce Investment Act of 1998 (WIA) - Prohibits discrimination in participation, benefits, and employment on the basis of age, sex, race, color, national origin, status as an individual with a disability, or political affiliation or belief, and for beneficiaries only, status as a United States citizen or individual legally authorized to work in the United States in programs and activities funded or otherwise financially assisted in whole or in part under the WIA.
  • 29 CFR Part 37 - Regulations regarding the nondiscrimination and equal opportunity provisions of the WIA.
  • Title II Subpart A of the Americans with Disabilities Act of 1990, as amended - Prohibits exclusion of qualified individuals, by reason of disability, from participation in or benefits of the services, programs, or activities of a public entity of from discrimination in employment.
