The Department of Labor Announces EEOICPA Ombudsman Appointment

WASHINGTONThe U.S. Department of Labor announced the appointment of Malcolm Nelson to serve as the Ombudsman for Part E of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA). Mr. Nelson's appointment fills the vacancy created when the first Ombudsman, Donald Shalhoub, was appointed deputy assistant secretary for the Occupational Safety and Health Administration.

The Defense Authorization Act of 2005 created the Office of the Ombudsman for a three-year period to provide information on the benefits available under Part E of the EEOICPA. The statute requires the Ombudsman to issue an annual report to Congress concerning complaints, grievances and requests for assistance received that year.

Nelson, a career government attorney, most recently served as general counsel for the Benefits Review Board, an appellate adjudicatory board exercising nationwide jurisdiction over appeals from the decisions of the Office of Administrative Law Judges under the Black Lung Benefits Act and the Longshore and Harbor Workers' Compensation Act administered by the Department of Labor. Nelson has also served as an acting administrative appeals judge for the Benefits Review Board. He has an A.B. from the University of Pennsylvania and a J.D. from the University of Pennsylvania.
