Voluntary Compliance Agreements

On December 14, 2007, the Department entered into a voluntary compliance agreement with the American Federation of Television and Radio Artists (AFTRA) Los Angeles Local concerning the challenged election of officers conducted on May 22, 2007. In that election, some members were mailed a ballot and election notice packet less than fifteen days prior to the date that ballots must have been returned in order to be counted. Also, there were errors in the tallying of ballots. The local agreed to conduct a new election for the nine Los Angeles Board of Director for Actors officer positions and the thirteen National Board of Directors officer positions that may have been affected by the violations. The voluntary compliance agreement follows an investigation by the Los Angeles District Office.

On November 30, 2007, the Department entered into a voluntary compliance agreement with Asbestos Workers Local 74 in Des Moines, Iowa, concerning the challenged election of officers conducted on May 8, 2007. In that election, nominees were improperly disqualified on the basis of a new dues payment policy of which they did not have sufficient notice. Local 74 agreed to conduct new nominations and a new election for business manager/financial secretary, five executive board members, and sergeant of arms under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Kansas City Resident Investigator Office.

On October 15, 2007, the Department entered into a voluntary compliance agreement with AFGE Local 1105 concerning a challenged election conducted on December 7, 2006. During the election, Local 1105 failed to elect its officers by secret ballot when adequate facilities were not provided to ensure voters privacy. Local 1105 also failed to: follow its constitution with respect to the time period for submitting nominations; properly notify all members of nominations and the election; maintain adequate safeguards over the ballots and ballot box; and maintain all election records for one year. Local 1105 agreed to conduct new nominations and a new election under OLMS supervision for the offices of president, vice president, secretary, treasurer, chief steward and delegate. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On August 28, 2007, the Department entered into a voluntary compliance agreement with the Brotherhood of Locomotive Engineers and Trainmen (BLET), Division 1 concerning a challenged election conducted on December 6, 2006. During the election, Division 1 failed to provide adequate safeguards where ballots were printed at the home of one of the candidates, records were not maintained to allow for a ballot reconciliation, undeliverable ballots were returned to the residence of one of the candidates, and candidates had access to the post office box for voted ballots. In addition, Division 1 failed to follow its bylaws provisions concerning a tie vote, and did not send both notice of the election and ballots to members who may have been in good standing or could have brought themselves into good standing before the election. Division 1 agreed to conduct new nominations, if necessary, and a new election under OLMS supervision for the offices of Vice President, Local Chairman-Norfolk Southern, Local Chairman-Conrail, two Vice Local Chairman-Conrail, Delegate to the State Legislative Board, and Delegate to the National Division. The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On August 24, 2007, the Department entered into a voluntary compliance agreement with Service Employees International Union (SEIU) Local 2001, Chapter 96 concerning a challenged election conducted on March 9, 2007. During the election, Local 2001, Chapter 96 failed to elect its officers by secret ballot where adequate facilities were not provided to ensure voter privacy or secrecy when voting. In addition, voted ballots were handed directly to union staff members running the polling site, in violation of the LMRDA. Local 2001, Chapter 96 agreed to conduct new nominations, if necessary, and a new election under OLMS supervision for the office of treasurer. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On July 2, 2007, the Department entered into a voluntary compliance agreement with American Federation of Government Employees Local 1547 concerning a challenged election conducted on November 21, 2006. During the election, a union officer obtained absentee ballots for the president's preferred candidate and provided them to union members to be cast. The local also failed to follow its constitution and bylaws which, prohibited a member of the election committee from being a candidate in an election. Local 1547 agreed to conduct new nominations and a new election under OLMS supervision for the offices of treasurer and administrative vice president. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On June 18, 2007, the Department entered into a voluntary compliance agreement with Stage & Picture Operators AFL-CIO, Local 871 concerning a challenged election conducted on December 11, 2006. Investigation disclosed that the union did not treat candidates equally with respect to the distribution of campaign literature and the posting of material on the union website. The union also may have failed to count some votes from eligible members. Local 871 agreed to conduct new nominations and a new election under OLMS supervision for the offices of president, vice president, treasurer, board of directors (10), and delegates (15), prior to October 31, 2007. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On June 12, 2007, the Department entered into a voluntary compliance agreement with Transport Workers Local 241 in New York City concerning a challenged election conducted on November 8, 2006. An OLMS investigation established that Local 241 failed to provide adequate safeguards when it failed verify that the sign-in roster did not match the number of ballots cast. Local 241 agreed to conduct a new election for the offices of president, vice president, recording secretary, and 2nd and 3rd executive board at-large members under OLMS supervision. The agreement follows an investigation by the New York District Office.

On June 11, 2007, the Department entered into a voluntary compliance agreement with the Brotherhood of Locomotive Engineers and Trainmen, IBT (BLET) Division 192, concerning a challenged election held in December 2006. BLET Division 192 agreed to conduct new nominations and a new election under OLMS supervision for the position of Local Chairman. BLET Division 192 failed to provide adequate safeguards during the election when it failed to count a valid ballot while counting invalid ballots. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On May 23, 2007, the Department entered into a voluntary compliance agreement with Local 2341 of the American Federation of Government Employees (AFGE) in New Orleans, Louisiana, concerning a challenged election of officers conducted on November 29, 2006. AFGE Local 2341 agrees to conduct a run-off election for the position of secretary treasurer under the supervision of the Secretary of Labor because the OLMS recount of ballots resulted in a tie vote and AFGE requires a majority to elect. In the event that one of the two secretary treasurer candidates declines to participate in the run-off, new nominations will be conducted for this position. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On April 16, 2007, the Department entered into a voluntary compliance agreement with the International Federation of Professional & Technical Engineers (IFPTE) Local 259, concerning a complaint that the 2006 regular election of officers had not been held in violation of LMRDA section 401(b). To remedy their failure to hold an election, IFPTE Local 259 agreed to conduct nominations and an election under OLMS supervision for President, First Vice President, Second Vice President, Third Vice President, Chief Steward, Secretary, and Treasurer. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On March 27, 2007, the Department entered into a voluntary compliance agreement with the Allied Pilots Association (APA) St. Louis Domicile concerning a challenged election conducted in March 2006. The OLMS investigation found that observers were not permitted during all phases of the election process as required by Section 401(c) of the LMRDA. In addition, there was a failure to elect by secret ballot as required by Section 401(e) of the Act. The APA agrees that OLMS will supervise an election for the positions of chairman and vice chairman of the St. Louis Domicile. The voluntary compliance agreement follows an investigation by the OLMS St. Louis District Office.

On February 20, 2007, the Department entered into a voluntary compliance agreement with Letter Carriers Branch 53 in Jacksonville, Florida concerning a challenged election conducted on August 9, 2006. Branch 53 agreed to conduct new nominations and a new election under the supervision of OLMS for the uncontested positions of president, executive vice president, recording secretary, financial secretary and five trustees. The voluntary compliance agreement follows an investigation by the OLMS Atlanta District Office.

On January 23, 2007, the Department entered into a voluntary settlement agreement with PACE Local 5-772 in Memphis, Tennessee concerning the failure of the local to hold an election in January 2006. Local 5-772 agreed to conduct nominations, an election, and the installation of officers for the offices of President, Vice-President of Memphis (MEM), Vice-President of Detroit (DTW), Vice-President of Minneapolis (MSP), Recording Secretary, Treasurer, and three Trustee positions prior to May 31, 2007 under the supervision of the Secretary of Labor. The settlement agreement follows an investigation by the OLMS Nashville District Office.

On January 18, 2007, the Department entered into a voluntary compliance agreement with Carpenters Local 58 concerning a challenged election conducted on June 13, 2006. Local 58 agreed to conduct new nominations and a new election under OLMS supervision for five delegates to the Chicago Regional Council of Carpenters. The voluntary compliance agreement follows an investigation by the OLMS Chicago District Office.

On January 17, 2007, the Department entered into a voluntary compliance agreement with National Postal Mail Handlers Union Local 312 concerning a challenged election conducted on July 22, 2006. Local 312 agreed to conduct new nominations and a new election under OLMS supervision for seven offices. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On December 12, 2006 the Department entered into a voluntary compliance agreement with the JL French Employee Committee in Sheboygan, Wisconsin, concerning the challenged June 20, 2006 election of chairperson. The JL French Employee Committee agreed to conduct a new election for the office of chairperson under OLMS supervision. The compliance agreement follows an investigation by the OLMS Milwaukee District Office.

On December 11, 2006, the Department entered into a voluntary compliance agreement with IATSE Local 500 in Oakland Park, Florida concerning the challenged June 3, 2006 election of officers. Local 500 agreed to conduct a new election for the offices of president, vice president, and secretary/business representative under OLMS supervision. The compliance agreement follows an investigation by the OLMS Atlanta District Office.

On November 10, 2006, the Department entered into a voluntary compliance agreement with Carpenters Local 272 concerning a challenged election conducted on June 12, 2006. Local 272 agreed to conduct nominations, an election, and installation under OLMS supervision for one delegate to the Chicago Regional Council of Carpenters. The voluntary compliance agreement follows an investigation by the OLMS Chicago District Office.

On November 2, 2006, the Department entered into a voluntary compliance agreement with American Federation of Government Employees Local 1972 concerning a challenged election conducted on February 14, 2006. Local 1972 agreed to conduct a new election under OLMS supervision for the offices of first vice president and vice president of professionals. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On October 18, 2006, the Department entered into a voluntary compliance agreement with Communications Workers of America Local 1400 concerning a challenged election for District One Vice President conducted on April 6, 2006. Local 1400 agreed to conduct a new election for District One Vice President under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On October 13, 2006, the Department entered into a voluntary compliance agreement with United Steelworkers Local 11-0001 concerning a challenged election of officers conducted on March 14, 2006. Local 11-0001 agreed to conduct new nominations and election for the offices of president and trustee. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On July 24, 2006, the Department entered into a voluntary compliance agreement with the Transport Workers Union of America, Air Transport Local 564, concerning a challenged election of officers conducted on December 15, 2005. Local 564 agreed to conduct a new election under OLMS supervision for the office of northern executive board member. The voluntary compliance agreement follows an investigation by the OLMS Los Angles District Office.

On July 20, 2006, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 28 concerning a challenged election of officers conducted by the local on December 2, 2005. The union agreed to conduct a new election under OLMS supervision for the offices of secretary, sergeant-at-arms, one trustee, and one delegate to the state convention. The voluntary compliance agreement follows an investigation by the OLMS Seattle District Office.

On July 12, 2006, the Department entered into a voluntary compliance agreement with Sindicato de Equipo Pesado Construccion Y Ramas concerning a complaint that the union failed to hold its January 2006 election of officers. The union agreed to conduct nominations and an election under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Puerto Rico Resident Investigator Office.

On June 19, 2007, the Department entered into a voluntary compliance agreement with the International Association of Machinists and Aerospace Workers (IAM) Local Lodge 141, concerning a challenged election held in December 2006. IAM LL 141 agreed to conduct new nominations (if necessary) and a new election under OLMS supervision for the conductor/sentinel position and two of the three trustee positions. IAM LL 141 failed to contact members about their lapsed dues and allowed some ineligible members to vote in the election in violation of LMRDA section 401(e). The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On June 12, 2006, the Department entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) concerning the challenged election conducted by AFGE Local 506. AFGE agreed to a new election conducted under OLMS supervision for the offices of president, executive vice president, vice president (low facility), vice president (medium facility), vice president (USP 1 facility), treasurer, and secretary. The voluntary agreement follows an investigation by the OLMS Atlanta District Office.

On May 24, 2006, the Department entered into a voluntary compliance agreement with United Steelworkers PACE Local 730 concerning a challenged election of officers conducted by the local on December 14, 2005. The union agreed to conduct a new election under OLMS supervision for the offices of president/delegate, vice president, chief steward, assistant chief steward, recording and corresponding secretary, financial secretary/treasurer, 3 trustees, and 2 sergeant-at-arms. The voluntary agreement follows an investigation by the OLMS Cleveland District Office.

On May 18, 2006, the Department entered into a voluntary compliance agreement with the National Treasury Employees Union, Chapter 98, concerning a challenged election of officers conducted on October 12-14, 2004. Chapter 98 agreed to conduct new nominations and a new election under OLMS supervision for the office of second vice president. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On April 6, 2006, the Department entered into a voluntary compliance agreement with the Laborers International Union concerning a challenged election of officers conducted by Laborers Local 89 on June 11, 2005. The Laborers International, which currently has the local under trusteeship, agreed to conduct new nominations and a new election in Local 89 under OLMS supervision for all officer positions when the local is brought out of trusteeship. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On March 20, 2006, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 359 in Huntsville, Alabama, concerning a challenged election of officers conducted by the local on October 25, 2005. Local 359 agreed to conduct a new election under OLMS supervision for the offices of President and Maintenance Craft Director. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On March 7, 2006, the Department entered into a voluntary compliance agreement with Communications Workers, Local 6132, concerning a challenged election of officers conducted on September 29, 2005. Local 6132 agreed to conduct a new election under OLMS supervision for the offices of president, 2nd vice president, secretary-treasurer and chief steward marketing. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On February 24, 2006, the Department entered into a voluntary compliance agreement with Laborers Local 132 concerning a challenged election of officers conducted by Local 132 on June 11, 2005. The local union agreed to conduct new nominations and a new election in Local 132 under OLMS supervision for the positions of Secretary-Treasurer and Business Manager. The voluntary compliance agreement follows an investigation by the OLMS Minneapolis Resident Investigative Office.

On February 14, 2006, the Department entered into a voluntary compliance agreement with United Auto Workers Local 235 concerning a challenged May 19, 2005 election of officers. Local 235 agreed to conduct new nominations and a new election under OLMS supervision for the office of Vice-President. The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On January 18, 2006, the Department entered into a voluntary compliance agreement with the National Treasury Employees Union (NTEU), Chapter 282, concerning a challenged election of officers conducted on October 14, 2004. Chapter 282 agreed to conduct new nominations and a new election under OLMS supervision for the office of chapter president. The voluntary compliance agreement follows an investigation by the OLMS Washington District Office.

On January 12, 2006 the Secretary entered into a voluntary compliance agreement with the American Postal Workers Union (APWU) Local 89 concerning a challenged election of officers conducted on June 10, 2005. APWU Local 89 has agreed to conduct a new election for the office of Director of Industrial Relations under OLMS supervision. The voluntary compliance agreement follows an investigation by the Philadelphia District Office.

On January 4, 2006, the Department entered into a voluntary compliance agreement with Electrical Workers (IBEW) LU 1228, Newton, Massachusetts, concerning a challenged election of officers conducted on June 4, 2005. Local 1228 agreed to conduct new nominations and a new election for the offices of president, vice president, business manager/financial secretary/international convention delegate, two international convention delegates, and two alternate convention delegates under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On December 5, 2005, the Department entered into a voluntary compliance agreement with the Bell Production Engineering Association, concerning a challenged election of officers conducted on September 14, 2005. The Association agreed to conduct a new election under OLMS supervision for president and zone 3 committeeman. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On October 25, 2005, the Department entered into a voluntary compliance agreement with the Indian Educators Federation (IEF), Local 4524, American Federation of Teachers, concerning a challenged local election of officers conducted December 1, 2004. IEF Local 4524 represents approximately 1500 teachers and school employees of the U.S. Department of the Interior, Bureau of Indian Affairs and Office of Special Trustees schools located in 20 states. Local 4524 agreed to conduct a new election under the supervision of OLMS for the offices of Executive Vice President, Treasurer, and Regions II, III and IV Vice Presidents. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On October 21, 2005, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 199, concerning a challenged local election of officers conducted April 5, 2005. Local 199 agreed to conduct a new election under OLMS supervision for the offices of President, Clerk Craft Director, Director of Industrial Relations, Assistant Treasurer, Board Members-at-large Maintenance Craft, Board Members-at-large Motor Vehicle Craft, and all state convention delegates. The voluntary compliance agreement follows an investigation by the OLMS Washington District Office.

On October 19, 2005, the Department entered into a voluntary compliance agreement with the American Train Dispatchers Association (ADTA) concerning a challenged election of the Burlington Northern and Santa Fe System Committee conducted December 15, 2004. The American Train Dispatchers Association agreed to conduct new nominations and election under OLMS supervision for six offices of Vice General Chairman/Local Chairman/Fort Worth Delegate of ATDA's Burlington Northern and Santa Fe System Committee. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On October 17, 2005, the Department entered into a voluntary compliance agreement with the 4,000 plus member Hawaii Nurses Association, concerning a challenged election of officers conducted on March 28, 2005. The Association agreed to conduct new nominations and a new election under OLMS supervision for President, Vice-President, Secretary, Treasurer, District Board of Directors (14), and Bargaining Unit Board of Directors (20). The voluntary compliance agreement follows an investigation by the OLMS Honolulu Resident Investigative Office.

On October 13, 2005, the Department entered into a voluntary agreement with Machinists Local Lodge 1746, concerning the challenged local lodge election of officers that was conducted April 20, 2005. Local Lodge 1746 agreed to allow the Secretary of Labor to supervise a new election for president, vice president, conductor-sentinel, and three trustees. The voluntary agreement follows an investigation by the OLMS New Haven Resident Investigator Office.

On October 6, 2005, the Department entered into a voluntary compliance agreement with the National Association of Letter Carriers, Branch 39, concerning a challenged local election of officers conducted March 16, 2005. Branch 39 agreed to conduct a new election under OLMS supervision for the offices of President, Vice-President, and Trustees. The voluntary compliance agreement follows an investigation by the OLMS Cincinnati District Office.

On October 5, 2005, the Department entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE), Local 1843, concerning a challenged election of officers conducted on March 30, 2005. Local 1843 agreed to conduct a new election under OLMS supervision for the offices of vice-president and chief steward. The voluntary compliance agreement follows an investigation by the OLMS New York District Office.

On August 29, 2005, the Department entered into a voluntary agreement with the American Federation of Government Employees (AFGE) and an affiliated local union, Local 1738, concerning the challenged Local 1738 election of officers that was completed December 4, 2004, in Salisbury, North Carolina. AFGE and Local 1738 agreed to allow the Secretary of Labor to supervise a new election for president, vice president-Fayetteville, vice president-Durham, trustee, and chief steward. This voluntary agreement resulted from an investigation by the OLMS Nashville District Office.
