OSHA Cites West Palm Beach Masonry Firm For Exposing
Workers to Fall Hazards
Agency Proposes $55,000 in Penalties

TAMPA, Fla. -- The U.S. Department of Labor's Occupational Safety and Health Administration has cited Ron Kendall Masonry, Inc., West Palm Beach, for exposing employees to fall hazards by not properly erecting scaffolding at an Altamonte Springs job site. The agency is proposing penalties totaling $55,000.

OSHA issued the citations and proposed penalties following an inspection of the firm's AMC Theater construction site at 433 Altamonte Dr., Altamonte Springs, Fla.

The company received two repeat citations with proposed penalties totaling $50,000 for failure to provide proper guardrails and full planking on a 32-foot-high scaffold. OSHA had cited the company in July 2000 for similar violations.

The agency also issued one serious citation with a proposed penalty of $5,000 for failing to adequately secure the scaffold to prevent it from tipping over.

"OSHA is committed to keeping workers from being exposed to fall hazards," said Les Grove, the agency's Tampa area director. "Scaffolding accidents occur too frequently, and we will do all that we can to prevent them."

The firm has 15 working days to contest the OSHA citation and proposed penalty before the independent Occupational Safety and Health Review Commission.

OSHA issues repeat citations when an employer has been cited previously for a substantially similar condition and the citation has become a final order of the Review Commission. Serious citations are issued when there is a substantial probability that death or serious physical harm could result from a hazard about which an employer knew or should have known.
