OSHA Cites Kirkland Construction Of Rye, Colo.
Investigation Of Fatal Accident Finds Alleged Safety Violations

ENGLEWOOD, Colo. -- The failure of a Colorado employer to protect employees working on a road construction project has resulted in $31,000 in proposed penalties against Kirkland Construction of Rye, Colo., following an investigation by the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA).

OSHA's Englewood area office issued citations for five alleged serious violations of safety standards for failure to protect workers in highway work-zones, following its investigation of a June 30 fatal accident on a road construction work site outside of La Junta, Colo. An employee of Kirkland was struck by a tractor trailer as it drove through the construction zone.

"This tragic accident could have been avoided by adherence to basic work-zone safety practices and OSHA standards," said John Healy, OSHA area office director in Englewood.

The alleged serious violations address the hazards of improper traffic controls, insufficient illumination, inadequate training, lack of protective equipment and inadequate first aid provisions.

A serious violation is one where there is substantial probability that death or serious physical harm could result, and the employer knew or should have known of the hazard.

Kirkland Construction has 15 working days from receipt of the citations to request an informal conference with the OSHA area director, or to contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission.
