SUBJECT: Memorandum of Understanding (MOU) between the Employment Standards Administration, Wage and Hour Division, and the Occupational Safety and Health Administration, U.S. Department of Labor

A. Purpose. This instruction provides guidelines for implementing the Memorandum of Understanding (MOU) between the Employment Standards Administration, Wage and Hour Division, (ESA/WH) and the Occupational Safety and Health Administration (OSHA).

B. Scope. This instruction applies OSHA-wide.

C. References.

D. Action. Regional Administrators and Area Directors shall ensure that the objectives and concepts inherent in the MOU, Appendix A, are effectively implemented in accordance with the guidelines set forth in G. of this instruction.

E. Federal Program Change. This instruction describes a Federal program change which affects State programs. Each Regional Administrator shall:

1. Ensure that this change is promptly forwarded to each State designee using a format consistent with the Plan Change Two-way Memorandum in Appendix P, OSHA Instruction STP 2.22A, CH-2.

2. Explain to each State designee, as requested, the technical content of the change and the OSH/ESA/State coordination procedures detailed in G.3. of this instruction.

3. Encourage the States to honor the terms of the MOU, as detailed in this instruction.

4. Ensure that State designees acknowledge receipt of this Federal program change in writing to the Regional Administrator as soon as the State's intention is known, but no later than 70 calendar days after the date of issuance (10 days for mailing and 60 days for response.) This acknowledgment must include a statement indication whether the State will honor the terms of the ESA/WH and OSHA MOU.

5. Ensure that State designees honoring the MOU submit State plan supplements, in accordance with OSHA Instruction STP 2.22A, CH- 3, as appropriate, following the established schedule that is agreed upon by the State and Regional Administrator to submit non-Field Operations Manual/OSHA Technical Manual Federal program changes.

a. The State plan supplement should be in the form of a State directive or policy/procedure document, which details procedures for implementing the MOU in the State. The plan supplement should address the State's providing training for ESA compliance personnel in the State's enforcement requirements, procedures for referring complaints to and accepting referrals from ESA, and means for interagency coordination, as set out in G. of this instruction.

b. The State's acknowledgement of the Plan Change Two-way Memorandum may fulfill the plan supplement requirement if the appropriate documentation is provided.

6. Review policies, instructions and guidelines issued by the State to determine that this change has been communicated to State personnel.

F. Background. The MOU between ESA/WH and OSHA sets forth a working relationship between the two agencies in order to protect the health and well being of the Nation's work force. It establishes a referral system between the two agencies which will provide for a coordinated enforcement effort, thereby securing the highest level of compliance with the Occupational Safety and Health Act and the various Federal Wage and Hour Laws which include:

o The Fair Labor Standards Act (FLSA);

o The Davis-Bacon Act (DBA) and related Acts;

o The Migrant and Seasonal Agricultural Worker Protection Act (MSPA);

o The Immigration and Nationality Act (the temporary alien agricultural (H-2A) worker provisions);

o The McNamara-O'Hara Service Contracts Act (SCA);

o The Walsh-Healey Public Contracts Act (PCA); and

o The Contract Work Hours and Safety Standards Act (CWHSSA).

1. This MOU is designed to develop cooperation between ESA/WH and OSHA in conducting training programs on the agencies' regulations and requirements and to ensure that ESA/WH and OSHA shall exchange information relating to complaints, inspections or investigations, violations discovered, monetary penalties, and other legal actions to enforce pertinent laws and regulations necessary to ensure coordinated enforcement.

2. The MOU further clarifies ESA/WH and OSHA's authority, outlines enforcement procedures and establishes means for interagency coordination.

G. Guidelines. Within the framework of the agreement, OSHA Regional Administrators and Area Directors will adhere to:

1. The areas of authority delineated in the MOU, and

2. The procedural guidelines established in the MOU as follows:

a. OSHA Regional Administrators will maintain contact with the appropriate ESA/WH Regional Administrators in order to coordinate the MOU. Contact and coordination is also required at the Area Office level between the respective Area and District Directors. (Appendix B is a directory of ESA/WH Regional and District Offices and Appendix C is a list of WHMIS County Codes and Associated District Offices by State and County names.)

b. When a jurisdictional or coordination question arises which cannot be resolved at the area or regional level, or guidance is required to make a decision, or the issue has nationwide impact, the Regional Administrator shall contact the appropriate OSHA directorate for resolution.

c. The OSHA Regional Administrator shall ensure that field personnel are provided with a copy of the MOU along with information and training concerning potential violations of ESA/WH requirements.

NOTE: The Office of Training and Education will distribute to each Regional Office a training package prepared by ESA/WH for training OSHA field staff of their requirements. In addition, ESA/WH will provide personnel, upon request, to give the necessary training to OSHA compliance officers at the local level.

d. The OSHA Regional Administrator will ensure that training to ESA/WH field personnel is provided, upon request, on OSHA's safety and health regulations.

NOTE: The Office of Training and Education developed an OSHA training package that has been distributed to ESA/WH and OSHA Regional Offices. This package, along with local information, may be used for the training.

e. The Regional Administrator shall ensure that annual follow-up or refresher training is provided to all affected field personnel.

f. Whenever potential violations of ESA/WH requirements are found during OSHA inspections, the compliance officer shall submit a referral form (OSHA-90) through the supervisor and Area Director to the Regional Administrator. Instructions for completing this referral form is found in OSHA Instruction ADM 1-1.12B, the Integrated Management Information System (IMIS) Forms Manual, Chapter XV. The OSHA-90 shall then be forwarded to the appropriate ESA/WH Regional Administrator or District Director.

g. In order to track activity related to this MOU, the Area Director shall enter the following IMIS Codes, as appropriate, on the OSHA-90, Block 14e, and/or Block 25c.

(1) Wage hour division - 1108 (2) Child labor issues - 1109

h. The Area Director shall evaluate all referrals received from ESA/WH (Form WH-24) and take appropriate action in accordance with OSHA Instruction CPL 2.45B, the Revised Field Operations Manual (FOM), Chapter IX.

i. The Area Director shall monitor the progress of actions taken on the referrals and send the results of any inspection conducted in response to the referral to the Regional Administrator with a copy to the appropriate ESA/WH Regional Administrator.

j. OSHA Regional Administrators shall meet periodically (at least annually) with their ESA/WH counterparts to report on the progress of actions taken on the referrals received from ESA/WH, and determine where improvement to the system may be necessary.

k. An evaluation of the MOU, covering the period January 1, through December 31, shall be made each year by the Regional Administrator and a summary shall be submitted to the Directorate of Compliance Programs by February 1, which includes, as a minimum, the following elements:

o The number of referrals received from ESA/WH o The number of inspections conducted based on the referrals o The number of serious citations issued o The number of referrals sent to ESA/WH o The number of referrals sent to ESA/WH that involved child labor issues o A narrative describing where improvements to the system may be necessary

3. Explain the substance of the MOU to State designees in State plan States.

a. Regional Administrators shall assist State designees in establishing personal contacts between State agencies and ESA Regional Administrators.

b. Questions regarding coordination between ESA/WH and OSHA State designees should be resolved at the local level in accordance with the terms of the agreement, and existing law and policy.

c. Coordination matters that cannot be decided at the local level shall be referred promptly by the State designees to the appropriate OSHA Regional Administrator for transmittal through the Office of Field Programs, to the appropriate OSHA directorate for assistance in solving the problem.

d. State designees shall be requested to keep the Regional Administrator informed of any problems and the resolutions thereof negotiated by ESA/WH and the State. The Regional Administrator shall forward information on such State/ESA decisions to the Directorate of Compliance Programs.

I. Purpose:

The purpose of this agreement is to set forth the working relationship between the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) and the Wage and Hour Division of the Employment Standards Administration (ESA) to protect the health and well-being of the Nation's workforce, and to establish a complaint/referral system between the two Agencies which will provide for a coordinated enforcement effort, thereby securing the highest level of compliance with the Occupational Safety and Health Act and the various Federal Wage and Hour laws, including the Fair Labor Standards Act; the McNamara-O'Hara Service Contract Act; the Walsh-Healey Public Contracts Act; the Contract Work Hours and Safety Standards Act; the Davis-Bacon and related Acts; the temporary alien agricultural (H-2A) worker provisions of the Immigration and Nationality Act; and the Migrant and Seasonal Agricultural Worker Protection Act.

II. Background:

The Occupational Safety and Health Act of 1970 (OSH Act) was enacted to assure so far as possible every working man and woman in the Nation safe and healthful working conditions and to preserve our human resources. It also established the Occupational Safety and Health Administration and authorizes the Secretary of Labor to set mandatory occupational safety and health standards and to provide an effective enforcement program; to conduct investigations and inspections; to determine the status of compliance with safety and health standards and regulations; and to issue citations for non-compliance with safety and health standards and regulations. The OSH Act requires employers to furnish employment free from recognized hazards that are causing or are likely to cause death or serious physical harm, and to comply with occupational safety and health standards issued under the OSH Act.

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping, and child labor standards for the Nation's workforce. The Wage and Hour Division (Wage and Hour) administers and enforces FLSA with respect to private sector and State and local government employment. In addition, it administers FLSA provisions concerning child labor and Federal statutes governing migrant and seasonal farmworker employment. FLSA authorizes the Secretary of Labor to conduct investigations and gather data on wages, hours, and other employment conditions or practices, in order to determine compliance with the Act.

The Act's child labor provisions are designed to protect the educational opportunities of minors and prohibit their employment in jobs and under conditions detrimental to their health or well-being. The standards have minimum age requirements for minors employed in non-agricultural and agricultural occupations.

The Wage and Hour Division is also responsible for Federal statutes that provide labor standards protection to migrant, seasonal, and temporary alien (H-2A) agricultural workers and employees who work on Federal and Federally-assisted contracts with the Federal Government. The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) protects migrant and seasonal workers in their dealings with farm labor contractors, agricultural employers, agricultural associations and providers of migrant housing. The temporary alien agricultural worker provisions of the Immigration and Nationality Act (INA) also provide protection to H-2A workers and U.S. workers in corresponding employment and also contain safety and health requirements for housing such workers. The McNamara-O'Hara Service Contract Act (SCA) applies to workers on Federal service contracts, and the Walsh-Healey Public Contracts Act (PCA) applies to workers on Federal supply contracts. The Davis-Bacon and Related Acts (DBRA) cover workers on Federal construction contracts and on construction contracts with State and local governments that are Federally-assisted. The Contract Work Hours Safety Standards Act (CWHSSA) sets overtime pay requirements on Federal contracts.

Occasionally, compliance officers from OSHA conducting investigations are presented with information concerning non-compliance with Federal wage and hour, migrant and seasonal, or temporary alien (H-2A) farmworker, and child labor standards. Conversely, Wage and Hour compliance officers are occasionally presented with information concerning health and safety conditions which may be in non-compliance with the OSH Act. It is the intention of this MOU to establish policy and procedures concerning an effective and efficient system for the exchange of this type of information between the two agencies.

III. Policies:

There will be the fullest possible cooperation and coordination between ESA and OSHA, at all organizational levels, in developing and carrying out compliance programs to ensure the health and well-being of the Nation's workforce.

For enforcement purposes, OSHA and ESA shall arrange for referrals, whenever appropriate. Such coordination of activities is necessary to ensure maximum enforcement of labor laws.

ESA shall respond to referrals from OSHA, and OSHA shall respond to referrals from ESA, concerning potential violations of the other Agency's requirements when appropriate, by conducting investigations in a timely manner.

ESA and OSHA will cooperate in developing and conducting training programs on the agencies' regulations and requirements. Such training is necessary to ensure that valid referrals are made when potential violations are found.

ESA and OSHA shall exchange information relating to complaints, inspections or investigations, violations discovered, imposition of civil monetary penalties or other legal actions taken to enforce pertinent laws and regulations, and all other information necessary to ensure coordinated enforcement.

State Programs

OSHA and Wage and Hour Regional Administrators will work together to facilitate referrals of violations to ESA from the relevant State agencies in those States which operate their own occupational safety and health programs under a plan approved by OSHA under Section 18 of the OSH Act (Plan States).

In those Plan States with child labor laws that contain prohibitions against employment in hazardous occupations or other restrictions, the Plan State agency may refer apparent violations of child labor laws to the appropriate State official responsible for enforcement of child labor regulations, in addition to referring them to Federal Wage and Hour.

OSHA will encourage Plan States to respond to referrals from ESA and State agencies concerning potential violations of the States' occupational safety and health standards or regulations by conducting investigations in a timely manner.

OSHA will encourage Plan States to participate in all training and information-sharing activities established under this MOU. OSHA and Wage and Hour Regional Administrators will coordinate Plan State participation in such activities.

IV. Implementation:

Under the terms of this agreement, each agency will:

A. Ensure that all field personnel are provided with a copy of this MOU.

B. Develop and distribute to all field personnel a directive outlining the policy concerning the implementation of this MOU, taking into consideration the appropriate lines of communication between Wage and Hour and OSHA Plan States.

C. Ensure that all field personnel are provided with information and training concerning the types of issues that will be referred, including the requirements of the OSH Act and the FLSA, MSPA, SCA, PCA, INA, CWHSSA, DBRA and implementing regulations.

D. Submit all referrals generated by compliance officers to the District/Area Director, who will then forward the referral to the other agency.

E. Evaluate referrals on a priority basis and take appropriate action.

F. Transmit to the other agency the results of any inspection conducted in response to a referral from that Agency.

G. Establish a system to monitor the progress of actions taken on referrals.

H. Conduct periodic regional meetings, as necessary, to report on the progress of actions taken on the other agency's referrals and evaluate the system.

V. Period of Agreement:

This MOU shall continue in effect unless modified in writing by mutual consent of both parties or terminated by either party upon 30 days advance written notice to the other.

This MOU does not preclude entering into separate agreements setting forth procedures for other special programs which can be addressed more efficiently and expeditiously by special agreement.

Nothing in this agreement is intended to diminish or otherwise affect the authority of either agency to implement its respective statutory functions.

This MOU will become effective on the date of the last signature.
