Wage and Hour Division

The Wage and Hour Division Division enforces:

  • the Federal minimum wage;
  • overtime pay requirements;
  • child labor requirements;
  • rights of farm workers;
  • polygraph (i.e., "lie detector") testing requirements;
  • rights to family and medical leave;
  • employment rights of nonimmigrant workers;
  • limits on deductions from employee wages to satisfy debts;
  • prevailing wage and fringe benefit requirements for most Federal contracts for services and construction.

Office of Workers' Compensation Programs

The Office of Workers' Compensation Programs (OWCP) administers three major disability compensation programs which provide wage replacement benefits, medical treatment, vocational rehabilitation and other benefits to certain workers or their dependents who experience work-related injury or occupational disease.

  • The Federal Employees' Compensation Act (FECA) program provides income and medical cost protection and return-to-work services to civilian employees of the Federal Government injured at work, and to certain other designated groups.
  • The Longshore and Harbor Workers' Compensation Act (LHWCH) program provides similar protection to private sector workers engaged in certain maritime and related employment.
  • The Black Lung Benefits program provides protection to the nation's coal miners totally disabled by pneumonoconiosis or to their survivors.
  • Beginning August 1, 2001, the Office of Workers' Compensation Programs began administering The Energy Employees Occupational Illness Compensation Program Act of 2000.

Office of Federal Contract Compliance Programs

The Office of Federal Contract Compliance Programs (OFCCP) has the responsibility of assuring that employers doing business with the Federal Government comply with the equal employment opportunity (EEO) and affirmative action provisions of their contracts and through the authorities mentioned, enforce non-discrimination and equal opportunity standards for all individuals, including women, minorities, Vietnam era veterans and persons with disabilities.

  • EXECUTIVE ORDER 11246, as amended,
  • SECTION 503 OF THE REHABILITATION ACT OF 1973, as amended, and
  • SECTION 4212 OF THE VIETNAM ERA VETERANS' READJUSTMENT ASSISTANCE ACT OF 1974, as amended,

OFCCP also shares enforcement authority under Title 1 of the Americans with Disabilities Act and the Immigration Reform and Control Act.

MONITORING CONTRACT COMPLIANCE
OFCCP monitors compliance primarily through compliance evaluations. This office also investigates complaints filed by individuals alleging discrimination on the basis of race, color, sex, religion, national origin, disability or covered veteran's status.

Office of Labor-Management Standards

The Office of Labor-Management Standards (OLMS)enforces provisions of the Labor-Management Reporting and Disclosure Act (LMRDA) and related laws which establish basic standards of democracy and fiscal responsibility for unions representing employees in private industry, Federal government employees, and Postal Service employees. OLMS administers provisions relating to electing union officers, safeguarding union funds and assets, establishing and maintaining trusteeships, and reporting and disclosure by unions, employers, labor relations consultants, union officers and employees, and surety companies. OLMS also administers the Secretary of Labor’s statutory responsibilities for the Mass Transit Employee Protection Program under Section 5333(b) of the Federal Mass Transit Act, commonly referred to as the Section 13(c) program.
