DiegelmanActing Assistant Attorney General for Administration SUBJECT: General Restriction on Movement After Competitive Appointment With the continuing changes in Departmental leadership, it is appropriate to issue a timely reminder to the Heads of Components concerning the general restriction on movement after competitive appointment. Title 5, Code of Federal Regulations (CFR) ยง330.501 restricts the movement of an employee for the first 90 days after a competitive appointment. This means an employee may not be promoted, reassigned, or transferred to a different line of work or a different geographical area until three months have elapsed since the employee's latest nontemporary competitive appointment. The Office of Personnel Management may waive the restriction against movement to a different geographical area when it is satisfied that the waiver is consistent with the principles of open competition. Please remind your managers, hiring officials, and human resources staffs of this requirement. |
