Overview

The OSHA and American Pyrotechnics Association (APA) Alliance focuses on providing APA members, OSHA personnel, and others, including small businesses, with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing accidents involving the manufacturing, transportation, storage, sale, and handling of commercial display fireworks and consumer fireworks and the use of commercial display fireworks.

In addition to these formal meetings, the OOSA and APA staff maintained regular contact throughout the reporting period to monitor the Alliance's progress and results.

  1. Events and Products

    Training and Education Goal


    • Work with OSHA to provide expertise to develop training and education programs on the safe and proper use of commercial display fireworks products. These programs would be delivered to OSHA personnel and other interested parties.
    Events

    Manufacturer, Consumer, and Display Site Training Seminars


    APA conducted three one-day pyrotechnics safety training seminars for OSHA staff and local fire and public enforcement officials. Approximately 61 attendees participated in the training seminars which were conducted by Gregg Smith, APA Safety Program Manager, as follows:

    • June 9, 2005 Harrisburg, Pennsylvania
    • June 22, 2005 Kansas City, Missouri
    • May 10, 2006 Harrisburg, Pennsylvania
    Topics discussed at the seminars included a review of applicable codes and regulations regarding the sale, manufacture, storage and transportation of consumer fireworks and industry best practices at public fireworks display sites. The seminar also covered fireworks display site safety and management and discussed types of displays (e.g. aerial, low level, land, floating platform and barge), display site venues and permits, equipment types and set-ups, personal protective equipment, lead pyrotechnician responsibilities and dealing with emergencies on the display site. The attendees also heard an overview of the Safe Explosives Act and its impact on the professional fireworks industry. Building on the successes of the Manufacturer, Consumer, and Display Site Training seminars held during May and June, 2005 in the regions, OSHA and APA worked together in early 2006 to schedule a second series of the training in the regions. The May 2006 training in Harrisburg, PA was the first in the series.

    Outreach and Communication Goals

    • APA will provide expertise to OSHA to develop and disseminate information through print and electronic media, including electronic assistance tools and links from OSHA's and APA's Web sites.

    OSHA Assistance for the Pyrotechnics Industry Safety and Health Topics Page


    The OSHA Assistance for the Pyrotechnics Industry Safety and Health Topics page includes two modules: Retail Sales Fireworks and Display Fireworks. The modules continue to provide information on common pyrotechnics industry hazards associated with the areas and possible solutions to the hazards. The page also provides information on what regulations apply to the industry and where to find additional information.

    APA representatives review the page and continue to serve as members of the page's editorial board. The following APA representatives are members of the page's editorial board:

    OSHA and APA Alliance Web Page

    OSHA continues to update its OSHA and APA Alliance Web page on the Agency's Web site. The Web page includes links to the OSHA and APA Alliance agreement, news releases, a photograph of the signing ceremony, activities and events, products and resources, and milestones and successes. For more information on the number of visits to the OSHA and APA Alliance Web page, please see the Alliance Program Reach table in Section C of this report.

    APA and OSHA Alliance Web Page

    APA continues to maintain an APA and OSHA Alliance Web page on the association's Web site, which links to the OSHA and APA Alliance Web page on OSHA's Web site. In addition, the APA and OSHA Alliance Web page also links to OSHA's pyrotechnics-related compliance assistance resources on the agency's Web site.

    Print and Electronic Media

    Information on the OSHA and APA Alliance and products have appeared in a number of print and online media, including: an OSHA News Release, the Alliance Program's, Alliance Quarterly Review, and OSHA's QuickTakes. For more information on the print and electronic media, please see the Alliance Program Reach table in Section C of this report.

    • Speak, exhibit, or appear at OSHA or APA events such as APA's Winter Educational Conference, Fall Annual Meeting, local meetings, or other events.
    Events

    APA's Fifty-Seventh Annual Convention and Trade Show, September 20-24, 2005, San Francisco, California


    On September 23, 2005, at APA's 57th Annual Meeting and Convention, held in San Francisco, California, Lee Smith, then Director, Office of Safety Systems, DSG, USDOL-OSHA, and Mat Chibbaro, Fire Protection Engineer, DSG, USDOL-OSHA, participated in forums and discussed the OSHA and APA Alliance and pyrotechnics safety and health issues.

    In addition, Emil Golias, Senior Industrial Hygienist, Salt Lake Technical Center, USDOL-OSHA, and Gregg Smith, APA Safety Manager, staffed an OSHA and APA Alliance exhibit booth during the Trade Show and distributed information and answered questions for approximately 400 attendees.

    • Promote and encourage APA members' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, and the Consultation Program and its Safety and Health Achievement Recognition Program.
    APA's Fifty-Seventh Annual Convention and Trade Show, September 20-24, 2005, San Francisco, California

    On September 20, 2005, Mat Chibbaro, Fire Protection Engineer, DSG, USDOL-OSHA, gave a presentation on OSHA's Consultation Program during a breakout session at the convention to approximately 25 attendees.

    • Share information among OSHA personnel and industry safety and health professionals regarding APA best practices or effective approaches and publicize results through outreach by APA and through OSHA- or APA-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).
    APA Tour of the Fourth of July Celebration Fireworks Display Site on the National Mall, Washington DC. July 1, 2005

    On July 1, 2005, APA Safety Program Manager Gregg Smith conducted a walking tour for OSHA staff of the fireworks display site for the national Fourth of July celebration on the national mall in Washington, DC. During the tour, he discussed the pyrotechnics industry's best practices and demonstrated how to safely use the equipment at the display site. In addition, he discussed the personal protective equipment being worn use by the workers who were preparing the fireworks. The following OSHA staff participated in the tour:

    • Work with other Alliance participants on specific issues and projects related to fireworks display site safety and other occupational hazards associated with fireworks manufacture, distribution, and retail sales establishments that are addressed and developed through the Alliance Program.

      During this reporting period, the OSHA and APA Alliance Implementation Team did not start work on programs or projects to address this goal.

    • Encourage APA members to build relationships with OSHA's Regional and Area Offices to address health and safety issues, including occupational hazards related to fireworks display operators.
    Establishing Relationships with Regional and Area Offices

    Gregg Smith, APA Safety Program Manager, has been working closely with OSHA's Regional and Area Offices staff, while establishing dates and locations to conduct the Manufacturer, Consumer, and Display Site Training seminars. He has established excellent working relationships with OSHA staff and as a result, Gregg is answering questions and providing technical expertise and guidance on pyrotechnics industry best practices to OSHA's staff in the regions.

    Promoting the National Dialogue Goals:

    • Raise industry awareness and demonstrate their own commitment to workplace safety and health whenever APA leaders address groups.

      During this reporting period, the OSHA and APA Alliance Implementation Team did not start work on programs or projects to address this goal.

    • Develop and disseminate case studies illustrating the business value of safety and health and publicize their results.

    • Convene or participate in forums, round table discussions, or stakeholder meetings on fireworks issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  2. Executive Summary

    In the second year of the Alliance, OSHA and APA continued its excellent working relationship. Through their Alliance, OSHA and APA are working together to reduce injuries and exposure to pyrotechnics industry hazards.

    OSHA continues to maintain an OSHA and APA Alliance Web page on the Agency's Web site. The Web page includes links to the OSHA and APA Alliance agreement, OSHA news releases, a photograph of the signing ceremony, and activities and events, products and resources, and milestones and successes. In addition, APA continues to promote the Alliance through its APA and OSHA Alliance Web page, which links to the OSHA and APA Alliance Web page on OSHA's Web site.

    The Alliance continues to review and provide information for OSHA Assistance for the Pyrotechnics Industry Safety sand Health Topics Page on the agency's Web site. In addition, APA representatives, Julie Heckman, Gregg Smith and Phil Grucci continue to serve on the OSHA editorial board for the page.

    Through the Alliance, OSHA and APA also shared safety and health information at APA's Fifty-Seventh Annual Convention and Trade Show, September 20-24, 2005, in San Francisco, California. For example, OSHA representatives participated in an interactive forum at APA Annual Meeting and Convention in San Francisco, CA, where they were available to answer technical and safety questions from APA's members. In addition, OSHA exhibited at the event, distribution OSHA safety and health information to the convention's attendees. An OSHA representative also conducted a workshop on OSHA's Consultation Program for APA's members.

    The OSHA and APA implementation team continued to work together to conduct training sessions for OSHA staff and local public fire and enforcement officials. During this reporting period, the Manufacturer, Consumer, and Display Site Training seminars were conducted by APA's Safety Manager Gregg Smith in Harrisburg, PA and Kansas City, MO. Approximately 61 attendees participated in the training seminars.

    The training seminars have continued to increase the OSHA, state and local fire and enforcement code officials' knowledge of pyrotechnics industry hazards and best practices to prevent injuries and illnesses. The seminars introduced OSHA staff and enforcement officials to the industry best practices for the safe handling, use, transportation and storage of pyrotechnics.

    In addition, as a result of the Alliance, OSHA staff have gained in-depth knowledge of the pyrotechnics industry through access to APA's experts. For example, Greg Smith, APA Safety Program Manager, has been working closely with OSHA's Regional and Area Offices staff, while establishing dates and locations to conduct the Manufacturer, Consumer, and Display Site Training seminars. He has established excellent working relationships with OSHA staff and as a result, Gregg is answering questions and providing technical expertise and guidance on pyrotechnics industry best practices to OSHA's staff in the regions.

IV. Upcoming Milestones

In the upcoming year, OSHA and APA will continue their excellent working relationship and work together on projects in support of the goals in the Alliance agreement. For example, OSHA and APA will continue to build on the successes of last year's training seminars by conducting additional Manufacturer, Consumer, and Display Site Training seminars in June 2006 in Denver, CO; Atlanta, GA; Boston, MA; New York, NY; and Seattle, WA. Gregg Smith, APA Safety Program Manager, will discuss applicable codes and regulations regarding the sale, manufacture, storage and transportation of consumer fireworks and industry best practices at public fireworks display sites. The sessions will cover fireworks display site safety and management and discuss types of displays (e.g. aerial, low level, land, floating platform and barge), display site venues and permits, equipment types and set-ups, personal protective equipment, lead pyrotechnician responsibilities and dealing with emergencies on the display site. The attendees will also hear an overview of the Safe Explosives Act and its impact on the professional fireworks industry. In addition, OSHA will post the PowerPoint® presentations from the Manufacturer, Consumer, and Display Site Training seminars on the agency's Limited Access Page (LAP), including the OSHA and APA Alliance LAP.

In addition, APA will promote OSHA's cooperative programs to its membership by publishing an OSHA-developed article on OSHA's Consultation Program in the association's newsletter. OSHA and APA are also planning to present a workshop on OSHA's Onsite Consultation Program at APA's 58th Annual Convention and Trade Show, September 2006 in Nashville, TN. In addition, OSHA may participate in an interactive question and answer forum at the meeting and OSHA may provide a workshop on the Consultation Program and potentially exhibit at the trade show.

Through the Alliance, OSHA and APA will continue to provide information to update OSHA's Assistance for the Pyrotechnics Industry Safety and Health Topics page. APA representatives, Julie Heckman, Gregg Smith and Phil Grucci will continue to serve as members of the editorial board and will provide feedback as appropriate.

Finally, the OSHA and APA Alliance implementation team will work together to draft an OSHA and APA Alliance renewal agreement. The Alliance renewal agreement will be signed during June 2006.
