OSHA Announces Safety & Health Partnership on PATH Construction Project

NEW YORK -- The U.S. Labor Department's Occupational Safety & Health Administration (OSHA) has signed a site safety and health partnership agreement with construction contractor Yonkers/Tully/Pegno Tri Venture, the General Contractors Association of New York, the Building and Construction Trades Council and the Utility & Transportation Contractors Association of New Jersey.

Yonkers/Tully/Pegno was one of the contractors involved in the removal of debris at the World Trade Center.

"OSHA now has partnerships with all the major contractors that participated in the remediation of the World Trade Center site," said Patricia Clark, regional administrator for OSHA in New York. "The partnerships give OSHA an opportunity to assist contractors in developing a workplace culture that focuses on safety and health."

The new partnership covers the ongoing redevelopment of the Port Authority Trans-Hudson (PATH) commuter train service between New Jersey and lower Manhattan. The downtown PATH Station was destroyed by the Sept. 11, 2001 terrorist attack on New York City

Yonkers/Tully/Pegno is the prime contractor for the project to demolish existing track, ties, ballast and utilities in the tunnels under the Hudson River. The project, which is expected to be complete by early 2004, also includes the installation of over three miles of new track and the construction of elevators and escalators. This contract will include a minimum of 20 subcontractors and at its peak may employ more than 300 trade employees.

Partnership signatories for OSHA included Regional Administrator Clark, Manhattan Area Director Richard Mendelson and Parsippany Area Director Philip M. Peist. Also signing were Thomas R. Smith, corporate safety director for Yonkers/Tully/Pegno, William Ryan, safety committee chair for the General Contractors Association of New York, Edward J. Malloy, president of the Building & Construction trades Council and Kevin Monaco, director of legislative and regulatory affairs for the Utility and Transportation Contractors Association of New Jersey.

Provisions in the partnership allow for the prime contractor to assist subcontractors in improving their safety and health programs. OSHA Compliance Assistance Specialists (CAS) will also help all contractors at the site comply with safety and health standards and will participate in onsite safety and health activities when invited. The CAS role is vital in OSHA's outreach efforts to the regulated community in a non-enforcement capacity.

Partnership agreements foster contractors' involvement in safety and health and offer incentives from OSHA that increase emphasis on employee safety & health concerns, including training or assistance with safety and industrial hygiene. The partnership neither precludes OSHA from addressing complaints, fatalities, or serious accidents, nor does it infringe on the rights of employees to report workplace hazards.
