Region 3 News Release: 04-117-PHI (osha 007) Date: Tues., Feb. 10, 2004 Contact: Kate Kugan Office: (215) 861-5101 Heinz Loft Contractor Pays $108,000 For Health And Safety Violations PITTSBURGH, Pa. -- Martin Enterprises, Inc., has agreed to pay $108,000 in penalties, initiate an internal safety audit system, and correct hazards identified by the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) at its demolition site at the Heinz Loft project in Pittsburgh. "This Administration is committed to protecting America's workers, and the workers of Martin Enterprises will be safer as a result of our enforcement efforts in this case," said U.S. Secretary of Labor Elaine L. Chao. Headquartered in Cleveland, Ohio, Martin Enterprises is an excavation and demolition contractor employing 130 people. OSHA initiated an inspection at the Heinz jobsite in response to a complaint alleging open elevator shafts, lack of fall protection, unsafe handling of debris and exposure to airborne lead fumes. As a result of the inspection, the company was cited for lack of fall protection; an inadequate hearing conservation program; excessive noise exposure; excessive lead exposure; lack of lead training; and inadequate hazard communication training. As part of the settlement agreement, Martin Enterprises has agreed not to contest the OSHA citations. The company will deploy an internal audit system, abate cited hazards and take a number of safety-related actions. The company will also hire a full-time, qualified safety director and conducting two eight-hour training seminars for all Martin Enterprises project managers, estimators and field supervisors.
