2003 Appropriation Language Changes

The information provided below describes substantive changes from the Department of Justice Appropriations Act, 2002. Non-substantive changes such as new funding requests, changes in the number of motor vehicles, or changes in references to fiscal years are not included. Also excluded from this discussion are deletion of separate language provisions that provided one-time rescissions and supplemental funding in 2002.

General Administration. Language is proposed deleting the provisions that place restrictions on the Department Leadership Program and the Offices of Legislative and Public Affairs in terms of positions, workyears, appropriation amounts, and augmentation through the use of details.

Detention Trustee. All detention resources are proposed to be transferred to this account and to remain available until expended. To afford the Detention Trustee maximum flexibility, language is proposed to allow funds to be transferred annually to the U.S. Marshals Services or the Immigration and Naturalization Service. Funding for detention activities previously included with Federal Prison Detention and the Immigration and Naturalization Service are requested in this appropriation.

Identification Systems Integration.

Language is proposed to provide for the Identification system Integration appropriation account to include funding for the integration of the Automated Biometric Identification System (IDENT) as operated by the Immigration and Naturalization Service with the Integrated Automated Identification system (IAFIS) as operated by the Federal Bureau of Investigation. Deletion of language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States.

Counterterrorism Fund. Language proposed to allow payments to the Drug Enforcement Administration for costs incurred for providing intelligence support to agencies conducting activities related to counterterrorism.

Administrative Review and Appeals. Deletion of language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is proposed.

General Legal Activities. Language is proposed to establish that counterterrorism-related funds remain available until expended. Deletion of language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is also proposed.

Legal Activities Office Automation. Language is proposed to define more specifically the expenses related to the design, development, engineering, acquisition, and implementation of office automation systems.

Salaries and Expenses, United States Attorneys. Language is proposed to delete the current limitations on positions and full-time equivalent workyears. Language is proposed to delete one-time language requiring certain funds be transferred to the Working Capital Fund. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

United States Marshals Service, Salaries and Expenses. Language is proposed to delete the current limitations on positions and full-time equivalent workyears and to merge language related to equipping courthouses. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

United States Marshals Service, Construction. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

Federal Prisoner Detention. Appropriations language is proposed for deletion. This language reflects the transfer of FPD resources to the Department's Detention Trustee.

Community Relations Service. Language is proposed to include reference to violence prevention.

Assets Forfeiture Fund. Language rescinding $40,000,000 of Super Surplus unobligated balances is deleted.

Federal Bureau of Investigation (FBI), Salaries and Expenses. Language is proposed to delete the one-time requirement to reimburse Acadian Ambulance & Air Med Services $53,000 for costs incurred during the December 1999 prison riot in St. Martin Parish Correctional Center, St. Martin Parish, Louisiana. Language is proposed to delete the current limitations on positions and full-time equivalent workyears. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

Drug Enforcement Administration, Salaries and Expenses. Language is proposed making $33,000,000 for permanent change of station costs, the maximum amount that may remain available for 2 years for this purpose. Language is proposed to delete the current limitations on positions and full-time equivalent workyears.

Immigration and Naturalization Service (INS). Language is proposed to delete the current INS account structure, which includes Salaries and Expenses, Enforcement and Border Affairs, and Citizenship and Benefits, Immigration Support and Program Direction, and Construction. As a result, new language is proposed to establish three accounts under the INS heading: Immigration Enforcement, Immigration Services, and Support and Administration. The new account structure more closely aligns INS appropriations with its functions. Language contained in the proposed provisions largely mirror those in current appropriations. Language is proposed to delete the current limitations on positions and full-time equivalent workyears. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

Office of Justice Programs (OJP) Justice Assistance. Language referring to the Omnibus Crime Control and Safe Streets Act as the 1968 Act is deleted. Language is proposed to refer section 821 of the Antiterrorism and Effective Death Penalty Act of 1996. Separate language related to sections 819 and 821 of the Antiterrorism and Effective Death Penalty Act of 1996 is deleted. Deletion of language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States.

Office of Justice Programs, State and Local Law Enforcement Assistance. Language is proposed to eliminate $400,000,000 for the Local Law Enforcement Block Grant program, as well as $70,000,000 for the Boys and Girls Club of America, and a $19,956,000 earmark for the law enforcement technology set-aside. Language is proposed to delete the $20,000,000 provided for the Cooperative Agreement Program (CAP) and $565,000,000 for the State Criminal Alien Assistance Program. Language proposed to provide $1,250,000 for the new Hate Crimes Training and Technology Assistance Initiative.

Language is proposed to delete the $200,000 earmark for the one-time study on standards and processed for forensic exams of domestic violence, as authorized by section 1405 of Public Law 106-386. Language is proposed to delete the $10,000,000 provided for victim services programs for victims of trafficking authorized by section 107(b)(2) of Public Law 106-38. Language is proposed to eliminate the $35,191,000 earmark for Indian County prison construction, as well as the $594,489,000 provided for Byrne Formula and Discretionary grants. Language is proposed to delete language providing a $200,000 earmark for a one-time study and report on the response of law enforcement agency response to emergency calls involving domestic violence authorized under VAWA II. Language is proposed to delete the $898,000 for the Missing Alzheimer's Disease Patients Alert Program and the $1,298,000 for the Motor Vehicle Theft Prevention Program.

Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.

Election Reform Program. New language proposed to establish this account to provide resources to states to improve their voting technology and election procedures.

Office of Justice Programs, Juvenile Justice Programs. Language is proposed to earmark up to $10,000,000 for training and technical assistance to assist small, nonprofit organizations with the Federal grants process. Language proposed that changes the title of the Safe Schools Initiative to School Safety Initiative. Language is proposed to provide $5,033,000 of Title V funding for Project Sentry. Language providing $25,000,000 for the Enforcing Underage Drinking Laws program is proposed for deletion.

Community Oriented Policing Services. Deletion of language that directs all prior year carryover funds to be used for the direct hiring of law enforcement officers through the Universal Hiring Programs. Deletion of language that allows all prior year carryover funds derived from the Violent Crime Trust Fund for Community Oriented Policing Services to be transferred into this appropriation, as well as the reference of officer redeployment demonstration is not required.

Language is proposed to decrease the amount of funding available for Public Safety and Community Policing Grants. The proposed language continues funding for the Police Corps and Bulletproof Vest programs, as well as programs to provide officers, training, and equipment to tribal law enforcement agencies, and to reduce methamphetamine trafficking and production.

Language is proposed to decrease the amount of funding available for Crime-Fighting Technology initiatives. The proposed language replaces the Law Enforcement Technology program with an innovative program to combat crime, COPS InfoTech initiative. The proposed language reduces funding for the Crime Identification Technology Act (CITA), but enhances funding available for the Criminal Records Upgrades program and provides separate funding, outside of CITA funding, for the safe schools technology initiative.

Language is proposed for Community Crime Prevention programs, including funds for the Police Integrity program, Project Sentry, and the Offender Re-entry program.

Language is proposed for a new $800,000,000 Justice Assistance Grants program that will consolidate the Department's state and local law enforcement block grants into one comprehensive program, including $60,000,000 for the Boys and Girls Clubs and $15,000,000 for facilitating neighborhood watch programs on terrorism preparedness.

Language is proposed providing $26,513,000 for the funding of Management and Administration expenses related to implementing the requested programs.

Crime Victims Fund. Language related to the emergency expenses related to the September 11, 2001 terrorist attacks on the United States is deleted.
