City of Fort Wayne, Indiana Agrees to Make $250 Million in Improvements to Sewer System (07-1034)
The City of Fort Wayne, Ind., has agreed to make an estimated $250 million worth of improvements to resolve longstanding problems with overflows from its sewer system, the Justice Department and Environmental Protection Agency (EPA) announced today. (Read more)

W.R. Grace to Pay Toward Cleanup of Hazardous Waste Sites (07-1019)
W.R. Grace, a global supplier of specialty chemicals, has agreed to a $34 million bankruptcy settlement for cleanup costs at 32 Superfund sites across the country, the Justice Department announced today. The action settles a bankruptcy claim brought by the federal government to recover money for Superfund site cleanup. (Read more)

Tanker Company Fined $4.9 Million for Falsifying Records and Obstruction of Justice (07-1012)
Repeat offender, Ionia Management, a Greek company that manages a fleet of tanker vessels, was sentenced today for its role in falsifying records to conceal the overboard dumping of waste oil from the M/T Kriton into international waters and its efforts to impede the investigation of the U.S. Coast Guard, announced Ronald J. Tenpas, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, Kevin J. Merck Settles Clean Water Act Violations at its Montgomery County, Pennsylvania Pharmaceutical Plant (07-100)
Merck, the global pharmaceutical research company, has agreed to resolve violations of federal and state water pollution control regulations arising from spills including a June 2006 spill at its pharmaceutical plant outside of Philadelphia, announced Pat Meehan, U.S. Attorney for the Eastern District of Pennsylvania, Ronald J. Tenpas, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, the Environmental Protection Agency, and the Pennsylvania Department of Environmental Protection. Ship’s Chief Engineer Sentenced for Obstruction of Justice and Conspiracy (07-964)
Petros Renieris, the chief engineer of the M/T Kriton, was sentenced today to two years probation and a $9,000 fine for his role in falsifying Oil Record Book entries to conceal the overboard dumping of waste oil from the tanker ship into international waters and his participation in subsequent efforts to impede the U.S. Coast Guard and other authorities from learning of the dumping, the Justice Department announced. A federal district court in Maine sentenced Petraia Maritime Ltd., late yesterday, to pay a fine of $525,000 and serve two years probation for violating the Act to Prevent Pollution From Ships (APPS), the Justice Department announced. (Read more)

Court Approves Water Rights Settlement in Washington State (07-938)
A federal judge in Seattle approved a water rights settlement that resolves a longstanding dispute regarding the regulation and use of groundwater in northwest Washington State, the Justice Department announced today. Acting Assistant Attorney General for the Environment and Natural Resources Division Ronald J. Tenpas remarked that “This settlement brings the parties together, reducing the possibility of future litigation and builds a framework for cooperation between the tribe, state, and private parties.” (Read more)

Texas Company and Two Individuals Indicted for Environmental Crimes (07-929)
Two individuals including a company executive have been indicted for their roles in a conspiracy to illegally transport and dispose of hazardous waste, the Justice Department announced. John Kessel, the president and owner of Texas Oil and Gathering, Inc., and Edgar Pettijohn, the company’s operations manager, were arrested and charged today with illegally disposing of hazardous waste at facilities only approved to take oil and gas production waste. Texas Oil and Gathering, Inc., a licensed hazardous waste transporter and used oil handler, was also named in the indictment. (Read more)

Massachusetts Man Pleads Guilty to Transporting Unlawfully Killed Black Bear Across State Lines (07-919)
A Leominster, Mass., man pleaded guilty today in U.S. District Court in Boston to a misdemeanor charge for his role in unlawfully killing and transporting a black bear (Ursus americanus) across state lines in violation of the Lacey Act, the Justice Department and the U.S. Attorney for the District of Massachusetts announced. New Mexico Business Owners Plead Guilty and Are Sentenced for Transporting Mountain Lion Across State Lines (07-901)
John “Tom” Boyer and his wife Deborah Boyer, owners of Let’s Tree It Outfitters in Reserve, N.M., pleaded guilty yesterday in federal court in Denver to a criminal information charging each of them with a misdemeanor violation of the Lacey Act, the Justice Department announced today. The Lacey Act prohibits the interstate transportation of wildlife which, in the exercise of due care, the transporter should have known was taken in violation of any state wildlife-related law. Hercules, Inc. Pays $12.95 Million for Environmental Cleanup Costs at Navy-owned, Contractor-operated Site (07-874)
Hercules, Inc., a former defense contractor, has agreed to pay the United States nearly $13 million toward the cleanup of the Allegany Ballistics Laboratory (ABL) site in Rocket Center, West Virginia, according to a settlement reached today with the Department of Justice, the Department of the Navy, and the U.S. Environmental Protection Agency (EPA). British Petroleum to Pay More Than $370 Million in Environmental Crimes, Fraud Cases (07-850)
British Petroleum and several of its subsidiaries have agreed to pay approximately $373 million in fines and restitution for environmental violations stemming from a fatal explosion at a Texas refinery in March 2005, leaks of crude oil from pipelines in Alaska, and fraud for conspiring to corner the market and manipulate the price of propane carried through Texas pipelines, the Department of Justice announced today. The Metropolitan Government of Nashville and Davidson County, Tenn. Agree to Extensive Sewer System Upgrades (07-842)
The Metropolitan Government of Nashville and Davidson County (Metro), at a cost of between $300 million and $400 million, has agreed to make extensive improvements to its sewer systems to eliminate unauthorized overflows of untreated raw sewage and to control overflows of combined sewage and storm water under a settlement announced today by the Justice Department, U.S. Environmental Protection Agency (EPA), and the Tennessee Attorney General’s Office and the Tennessee Department of Environment and Conservation (TDEC). Former Eastern Idaho Man Sentenced for Hazardous Waste Violations (07-837)
Krister Sven Everston, of Wasilla, Alaska, also known as Krister Ericksson was sentenced today to 21 months in prison for illegally transporting hazardous materials and illegally storing hazardous waste, the Justice Department announced. He was also ordered to pay restitution in the amount of $421,049 and placed on supervised leave for 3 years. (Read more)

Rowan Companies and Nine Supervisory Employees Plead Guilty to Environmental Crimes in Connection with Oil and Gas Drilling Operations (07-802)
Rowan Companies, Inc., a major oil and gas drilling company, pleaded guilty today in U.S. District Court in Beaumont, Texas, to three felonies in connection with the routine discharge of pollutants and garbage into the Gulf of Mexico from one of the firm’s oil rigs, the Justice Department announced. On October 9, 2007, the United States, eight states, and thirteen citizen groups announced a settlement agreement with American Electric Power (AEP) under the Clean Air Act’s (Act) New Source Review (NSR) provisions that obtains relief at sixteen (16) of AEP’s coal-fired power plants (46 units) located in Indiana, Kentucky, Ohio, Virginia, and West Virginia. U.S. Announces Largest Single Environmental Settlement in History (07-797)
American Electric Power has agreed to cut 813,000 tons of air pollutants annually at an estimated cost of more than $4.6 billion, pay a $15 million penalty, and spend $60 million on projects to mitigate the adverse effects of its past excess emissions. Hunt Refining Settles Federal Air Pollution Case for $49 Million (07-781)
The Hunt Refining Co. and Hunt Southland Refining Co. have agreed to pay a $400,000 civil penalty and spend more than $48.5 million for new and upgraded pollution controls at three refineries, the Justice Department and U.S. Environmental Protection Agency announced. The settlement resolves alleged violations of the Clean Air Act and is expected to reduce more than 1,250 tons of harmful emissions annually from the company's refineries in Tuscaloosa, Ala., and Sandersville and Lumberton, Miss. In a landmark settlement filed today, East Kentucky Power Cooperative, a coal-fired electric utility, has agreed to pay an $11.4 million penalty to resolve violations of the Clean Air Act’s acid rain program, the Department of Justice and the U.S. Environmental Protection Agency announced today. Ship Operator Pleads Guilty and Sentenced to Pay $10 Million Related to Charges Arising from Grounding in the Aleutians (07-644)
IMC Shipping Co. Pte. Ltd. (IMC), a Singapore corporation, pleaded guilty today in federal court in Alaska to a three-count information alleging two violations of the Refuse Act for the illegal discharge of oil and soy beans and one violation of the Migratory Bird Treaty Act for killing of thousands of migratory birds that resulted from the grounding of the M/V Selendang Ayu on Dec. 8, 2004 in the Alaska Maritime National Wildlife Refuge. IMC was subsequently sentenced to pay a criminal penalty of $10 million. (Read more)

Valero Energy Agrees to $232 Million in Clean Air Act Pollution Controls (07-626)
The Department of Justice and the U.S. Environmental Protection Agency have reached an agreement with Valero Energy Corp. that provides for a $4.25 million penalty and $232 million in new and upgraded pollution controls at refineries in Tennessee, Ohio and Texas that were formerly owned by Premcor Inc. Texas Man Sentenced to Five Months in Jail for Environmental Crimes (07-625)
Dennis Rodriguez of El Paso, Texas, has been sentenced to five months imprisonment for environmental crimes related to the operation of his company, North American Waste Assistance, LLC (NAWA), which is located in the West Texas city, the Justice Department announced today. Under the plea agreement reached in February of this year, Rodriguez plead guilty to making a material false statement or representation in a manifest used to transport hazardous waste and to two counts of transporting hazardous waste to a facility that did not have a permit issued pursuant to the Resource Conservation and Recovery Act (RCRA). Besides the period of imprisonment, he was also sentenced to five months home confinement, two years of supervised release and ordered to pay a $10,000 fine. (Read more)
Shipping Company to Pay $1.3 Million for Vessel Pollution Charges (07-623)
Greek-based shipping company Kassian Maritime Navigation Agency Ltd. and Second Assistant Engineer Spyridon Markou were sentenced today in connection with dumping of bilge and wastewater into the ocean from the company’s ship, M/V North Princess, an ocean-going bulk cargo ship traveling to ports in the United States, the Justice Department announced. Kassian had pleaded guilty in July to charges that the company maintained false records in violation the Act to Prevent Pollution from Ships. (Read more)

The Justice Department and the U.S. Department of Transportation’s (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) announced today a settlement requiring comprehensive reform on El Paso Natural Gas Company’s (EPNG) entire 10,000 mile pipeline system. Acuity Specialty Products Group Pleads Guilty to Violating Clean Water Act (07-476)
Acuity Specialty Products, Inc., (Acuity) a company that has a manufacturing plant in Atlanta pleaded guilty to a one-count information charging it with a knowing violation of the Clean Water Act. Per the terms of the plea agreement, U.S. District Judge Marvin H. Shoob imposed a sentence of three years of probation and a fine of $3.8 million. (Read more)

Federal Superfund Settlement Will Ensure Cleanup of Foote Mineral Site (07-467)
The Justice Department and Environmental Protection Agency (EPA) announced a settlement that will ensure the expedited cleanup of the Foote Mineral Superfund Site, in Chester County, Pa. The settling defendant, which has expended approximately $7 million on cleanup actions already, will pay approximately $15 million to complete cleanup work of the site. In addition, the settling defendant has agreed to reimburse the EPA for a portion of the cleanup costs incurred for response actions at the site. (Read more)

U.S. Announces $60.7 Million Clean Air Act Settlement with Nevada Power (07-429)
The Department of Justice and the Environmental Protection Agency (EPA) today announced a $60.7 million Clean Air Act settlement with Nevada Power Company that will improve air quality in the Clark County/Las Vegas, Nev. area by requiring the company to reduce emissions of nitrogen oxides (NOx), a harmful air pollutant, from its Clark Generating Station by about 2,300 tons annually. The agreement provides for site-wide cleanup estimated to cost approximately $48 million, payment of over $9 million for future federal and state oversight costs, and recovery of over $17 million in past response costs incurred by federal and state agencies at the site. Sparks, Nevada-based Company Pleads Guilty to Violating the Clean Water Act (07-226)
Greg Street Plating Inc.—an electroplating, metal plating and finishing company based in Sparks, Nev.—pleaded guilty to a one-count indictment charging the company with discharging highly acidic waste into the sewer system that leads to the Truckee Meadows Sewage treatment facility, in violation of the Clean Water Act.
