TWO MEN SENTENCED FOR CRIMINAL VIOLATIONS RELATING TO ILLEGAL ASBESTOS REMOVAL ACTIVITIES THROUGHOUT NEW YORK STATE (04-803)
WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department's Environment and Natural Resources Division and Glenn T. Suddaby, U.S. Attorney for the Northern District of New York announced today that Alex Salvagno, 39 years old of Loudon, New York, and his father, Raul Salvagno, 71, of Ormond Beach, Florida, were sentenced in U.S. District Court, Syracuse, New York to 25 years and 19 ½ years of imprisonment, respectively, following their convictions for crimes related to illegal asbestos removal activities throughout New York State. U.S. - WASA SEWAGE SETTLEMENT TO CLEAN UP D.C.'S ANACOSTIA RIVER (04-793)
WASHINGTON D.C. - A milestone legal agreement filed in U. S. District Court for the District of Columbia today is expected to nearly eliminate massive overflows of sewage-contaminated storm water into the waterways of the nation’s capital, specifically the Anacostia River, the Potomac River and Rock Creek, the Justice Department and the Environmental Protection Agency (EPA) announced. LAVACA BAY SETTLEMENT BETWEEN U.S., TEXAS, AND ALCOA PROVIDES AREA RESTORATION PROJECTS AND ADDITIONAL CLEANUP (04-787)
WASHINGTON, D.C. - The Department of Justice, U.S. Environmental Protection Agency, National Oceanic and Atmospheric Administration, Department of the Interior, Texas Attorney General’s Office, Texas Commission on Environmental Quality, and the Texas Parks and Wildlife Department today announced two settlement agreements with Alcoa Inc. and Alcoa World Alumina L.L.C. that address mercury-contaminated sediments in Lavaca Bay, ongoing unpermitted discharges of mercury into Lavaca Bay, and soil contamination at the Point Comfort/Lavaca Bay Superfund Site. JUSTICE DEPARTMENT ALLEGES VIOLATIONS AT AGRIPROCESSORS, INC. MEAT PACKING PLANT IN POSTVILLE, IOWA (04-770)
WASHINGTON, D.C. - The Department of Justice and the U.S. Environmental Protection Agency announced today the filing of a civil action against AgriProcessors, Inc., a meat packaging plant in Postville, Iowa. The complaint, filed in the U.S. District Court for the Northern District of Iowa, alleges that AgriProcessors has committed Clean Water Act violations by failing to comply with pretreatment requirements for its wastewater going into a lagoon treatment system owned by the City of Postville and then discharged into the Yellow River. U.S. AND STATE OF TENNESSEE ANNOUNCE CLEAN WATER ACT AGREEMENT WITH THE KNOXVILLE UTILITIES BOARD TO ADDRESS SEWAGE OVERFLOWS (04-767)
WASHINGTON, D.C. - The Department of Justice, the U.S. Environmental Protection Agency, and the Tennessee Department of Environment and Conservation jointly announced today a comprehensive Clean Water Act settlement with the Knoxville Utilities Board (KUB). The settlement will ensure the proper management, operation, and maintenance of KUB’s sewer system including measures to prevent overflows of untreated sewage. (Read more)

DEPARTMENT OF JUSTICE ANNOUNCES HUMAN TRAFFICKING TASK FORCE IN THE DISTRICT OF COLUMBIA AND GRANTS FOR LAW ENFORCEMENT TO FIGHT HUMAN TRAFFICKING AND ASSIST VICTIMS (04-760)
WASHINGTON, D.C. - Assistant Attorney General R. Alexander Acosta of the Civil Rights Division, Assistant Attorney General Christopher A. Wray of the Criminal Division and U.S. Attorney Kenneth L. Wainstein of the District of Columbia announced today that the Department of Justice is awarding more than $7.6 million in grants-of which $450,000 will go to the District of Columbia-to enable state and local law enforcement to fight human trafficking by creating task forces to aid in the identification and rescue of human trafficking victims. LOS ANGELES, CA - The Department of Justice, U.S. Environmental Protection Agency, and the Santa Ana Regional Water Quality Control Board announced today they have filed a consent decree that ensures that the Orange County Sanitation District in Southern California will achieve full secondary treatment by Dec. 31, 2012. HELENA, M.T. - The Department of Justice and the U.S. Environmental Protection Agency announced today they have reached an agreement with Atlantic Richfield in a consent decree reimbursing the federal government for cleanup costs at four portions of the Clark Fork Basin Superfund sites. (Read more)

JUSTICE DEPARTMENT ANNOUNCES FY 2004 RECORD YEAR IN OBTAINING OVER $4 BILLION FOR ENVIRONMENTAL IMPROVEMENT (04-686)
WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General of the Justice Department’s Environment and Natural Resources Division, announced today that Fiscal Year 2004 was a record breaking year in the Division’s efforts to secure commitments by polluters to take action to remedy their violations of the nation’s environmental laws. Polluters across the nation agreed to spend in excess of $4 billion-topping the previous record of just more than $3 billion in FY 2002-to take corrective measures to protect the nation’s health, welfare and environment. U.S. ANNOUNCES CLEAN AIR AGREEMENT WITH CITGO PETROLEUM CORP (04-685)
WASHINGTON, D.C. - The Department of Justice and the U.S. Environmental Protection Agency today announced a comprehensive Clean Air Act settlement with CITGO. The settlement is expected to reduce harmful air emissions by more than 30,000 tons per year from six petroleum refineries in five states that represent nearly 5 percent of total refining capacity in the United States. EXPLORER PIPELINE PAYS $3 MILLION CIVIL PENALTY FOR DISCHARGE FROM ITS PIPELINE IN TEXAS (04-671)
WASHINGTON, D.C. - The Justice Department and the Environmental Protection Agency today announced they have reached a settlement with Explorer Pipeline Company, in which the company has paid a civil penalty of $3 million for violation of the Clean Water Act as amended by the Oil Pollution Act of 1990. According to the complaint filed simultaneously with a stipulated judgment and dismissal, the violation stemmed from a March 9, 2000 discharge of 13,436 barrels of gasoline containing the fuel additive MTBE from a pipeline owned by Explorer and located near Greenville, Texas. CHEVRON PHILLIPS TO PAY $1.8 MILLION CIVIL PENALTY FOR EXPLOSIONS AT PASADENA, TEXAS CHEMICAL PLANT (04-668)
WASHINGTON, D.C. - The Justice Department and the U.S. Environmental Protection Agency (EPA) today announced they have reached a settlement with Chevron Phillips Chemical Company in which the company will pay a $1.8 civil penalty for Clean Air Act violations that led to two explosions and releases of chemicals into the air from a chemical manufacturing plant in Pasadena, Texas in 1999 and 2000. This is the largest civil penalty ever assessed for a case of this type. (Read more)
DIRECTOR OF PUERTO RICAN ISUZU DISTRIBUTOR AGREES TO PLEAD GUILTY TO A FELONY VIOLATION OF CLEAN WATER ACT (04-667)
SAN JUAN, PUERTO RICO - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division; Peter J. Murtha, Director of the U.S. Environmental Protection Agency’s Office of Criminal Enforcement, Forensics and Training; H.S. Garcia, U.S. Attorney for the District of Puerto Rico; and Luis Fraticelli, Special Agent in Charge for the Federal Bureau of Investigation in Puerto Rico, announced today that Isuzu de Puerto Rico, Inc., and its Chairman of the Board, Digno Emérito Estrada-Rivera have agreed to plead guilty to a felony charge of violating the Clean Water Act by knowingly discharging a pollutant from a point source into navigable waters of the United States without a permit. COMPANY TO PAY $1.5 MILLION FOR NATURAL RESOURCE DAMAGES STEMMING FROM OIL SPILL INTO DELAWARE BAY (04-666)
WASHINGTON, D.C. - The Department of Justice, on behalf of the Departments of Interior and Commerce, and the State of New Jersey, announced today that France Shipmanagement S.A., the operator of the tank vessel Anitra-from which there was an estimated 40,000 gallon oil spill in 1996 into the Delaware Bay off the coast of New Jersey-has agreed to pay the United States and State of New Jersey a combined $1.5 million to resolve allegations that the spill resulted in injury to natural resources. U.S. REACHES SETTLEMENT WITH BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY TO CLEAN UP ALBUQUERQUE SUPERFUND SITE (04-659)
WASHINGTON, D.C. - The Department of Justice (DOJ), U.S. Environmental Protection Agency (EPA), Department of the Interior (DOI), and the State of New Mexico today announced two settlement agreements under which the Burlington Northern and Santa Fe Railway Company (BNSF) will cleanup the AT & SF Albuquerque Superfund Site in Albuquerque, New Mexico and reimburse EPA, DOI and the State of New Mexico for costs incurred in connection with the site. EPA and the state estimate that the cleanup will cost $64 million. BNSF has also agreed to pay DOI and the State of New Mexico approximately $1.1 million to restore injured natural resources (Read more)

TWO SHIP ENGINEERS PLEAD GUILTY TO MAKING FALSE STATEMENTS TO CONCEAL THE DUMPING OF WASTE OIL (04-603)
PORTLAND, ME. - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, and Paula D. Silsby, the U.S. Attorney for the District of Maine, announced today that late yesterday two chief engineers for a freighter pled guilty for their role in concealing the overboard dumping of waste oil from the M/V Kent Navigator and using false log books designed to deceive the U.S. Coast Guard. The defendants, Chief Engineers Felipe B. Arcolas and Alfredo D. Lozada, worked aboard the Kent Navigator, which is owned and managed by Petraia Maritime Ltd. (Read more)

“Today, the United States filed a notice in the U.S. District Court for the Southern District of West Virginia that would appeal the District Court’s decision in Ohio Valley Environmental Coalition v. Bulen to U.S. Court of Appeals for the Fourth Circuit. The appeal is in response to the District Court’s order enjoining many coal mining projects in southern West Virginia. The court’s ruling invalidated a Clean Water Act permit known as Nationwide Permit 21, or “NWP 21,” under which the U.S. Army Corps of Engineers may authorize surface mining projects to discharge rock, dirt, and other fill material into streams if the discharges will have only minimal adverse effects on the environment. Cruden, Indiana Governor Joe Kernan, and Assistant Secretary of the Interior Lynn Scarlett announced today that eight companies have agreed to pay nearly $60 million to restore natural resources in the Grand Calumet River and Indiana Harbor Canal. WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, and David P. York, U.S. Attorney for the Southern District of Alabama, announced today that Don Milton White of Mobile, Alabama was sentenced to serve 6 months in a community correction facility, 3 years supervised probation, pay $20,000 in restitution to the Environmental Protection Agency, and a $200 special assessment for having dumped hazardous waste at two abandoned industrial sites in the Mobile area. IOWA-BASED SHIP OPERATOR SENTENCED FOR ILLEGAL OCEAN DUMPING (04-552)
CEDAR RAPIDS, IOWA - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, and Charles W. Larson, Sr., U.S. Attorney for the Northern District of Iowa, announced today that an Iowa-based shipping company that transported grain cargoes and petroleum products in the United States and abroad was sentenced to pay $2 million for illegally dumping thousands of gallons of waste oil, hundreds of tons of diesel-contaminated grain, and plastic wastes at sea. WASHINGTON -- Thomas Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division announced today that Phelps Dodge Morenci, Inc., has pled guilty to a single misdemeanor count of violating the Migratory Bird Treaty Act in federal district court in Phoenix, Arizona. TANKER FIRM SENTENCED FOR CONCEALING DUMPING OF WASTE OIL (04-546)
WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, and Christopher J. Christie, U.S. Attorney for the District of New Jersey, announced today that a Connecticut-based shipping company that transports petroleum products in the United States and abroad was sentenced to pay $4.2 million for illegally concealing the dumping of thousands of gallons of waste oil and sludge at sea. LOS ANGELES - In one of the largest sewage cases in U.S. history, the Department of Justice, U.S. Environmental Protection Agency, the Los Angeles Regional Water Quality Control Board, Santa Monica Baykeeper, and a coalition of Los Angeles community groups have reached a $2 billion settlement with the city of Los Angeles over years of sewage spills. CHICAGO, IL - The U.S. Department of Justice, on behalf of the U.S. Environmental Protection Agency, and the Illinois Attorney General, on behalf of the Illinois EPA today announced a proposed settlement that would hasten the cleanup and redevelopment of the heavily-polluted former Waukegan Coke Plant on Waukegan Harbor. PERUVIAN ORCHID DEALER SENTENCED TO 21 MONTHS IN MIAMI FOR SMUGGLING PROTECTED PERUVIAN ORCHIDS (04-515)
WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division announced today that U.S. District Judge Patricia Seitz has sentenced Manuel G. Arias Silva, a Peruvian national, for his role in a conspiracy to import into the U.S. protected orchid specimens, including specifically specimens of the genus Phragmipedium, commonly known as Tropical Lady’s Slipper Orchids. Arias Silva was sentenced to 21 months with three years supervised release and ordered to pay a fine of $5000. (Read more)

WASHINGTON, D.C. - The Department of Justice and the U.S. Environmental Protection Agency today announced two agreements valued at nearly $1 million to assist in the cleanup of the Denova Environmental Superfund Site located in Rialto, California. In addition to providing for cleanup and repayment of EPA cleanup costs, the agreements pave the way for retailer Target Corp. to proceed with a project that will bring new jobs to the area. U.S. ANNOUNCES SETTLEMENT WORTH OVER $3 MILLION FOR LEAF RIVER OIL SPILL IN MISSISSIPPI FROM GENESIS PIPELINE (04-442)
WASHINGTON, D.C. - The Justice Department, U.S. Environmental Protection Agency, and the State of Mississippi today announced a settlement with Genesis Energy, Inc., Genesis Crude Oil, L.P., and Genesis Pipeline USA, L.P. (Genesis) for penalties and natural resource restoration and damages. Genesis will spend over $3 million as a result of an oil spill which discharged 336,000 gallons of crude oil near Soso, in Jones County, Mississippi, reaching the Leaf River and making it the largest oil spill in Mississippi since the enactment of the Oil Pollution Act of 1990. U.S. AND PREPA REACH AGREEMENT FOR MORE POLLUTION REDUCTIONS AT FOUR POWER PLANTS (04-433)
PUERTO RICO - The federal government announced today that it has reached an agreement with the Puerto Rico Electric Power Authority (PREPA) that will result in substantial environmental and health benefits for the local communities. The agreement between the Department of Justice, on behalf of the U.S. Environmental Protection Agency (EPA) and PREPA, will modify a 1999 consent decree reached with the participation of Comunidaes Unidas Contras La Contamination (CUCCo), a prominent citizens’ environmental organization. PHELPS DODGE SIERRITA TO PAY $1.4 MILLION TO SETTLE AIR POLLUTION VIOLATIONS (04-421)
SAN FRANCISCO - The Department of Justice and the U.S. Environmental Protection Agency today announced that Phelps Dodge Sierrita, Inc. has agreed to pay $1.4 million for allegedly violating the federal Clean Air Act. The EPA estimates that more than 1,000 tons of sulfur dioxide were illegally discharged into the air from the copper mine and ore processing plant near Green Valley, Arizona. (Read more)

U.S. ANNOUNCES SETTLEMENT WITH FIVE RUBBER COMPANIES AT THE INDUSTRIAL EXCESS LANDFILL SUPERFUND SITE IN OHIO (04-411)
WASHINGTON, D.C. - The Department of Justice announced that under a settlement agreement being lodged today at the federal court in Cleveland, five rubber companies will perform the remedy for the Industrial Excess Landfill Superfund Site in Uniontown, Ohio. The settlement also requires the companies to reimburse the government about $18 million in costs incurred by the U.S. Environmental Protection Agency for work already performed at the site. VIRGINIA ORCHID DEALER PLEADS GUILTY TO VIOLATING THE ENDANGERED SPECIES ACT (04-397)
WASHINGTON, D.C. - The Department of Justice announced that James Michael Kovach of Goldvein, Virginia, today entered a plea of guilty in the U.S. District Court in Tampa, Florida, to two misdemeanor counts of violating the Endangered Species Act. GRAND JURY IN JACKSON, MISSISSIPPI, CHARGES THREE INDIVIDUALS AND TWO CORPORATIONS WITH WETLANDS VIOLATIONS (04-396)
WASHINGTON, D.C. - The Department of Justice and the U.S. Attorney’s Office for the Southern District of Mississippi announced today that a federal grand jury in Jackson, Mississippi, has charged three individuals and two corporations with crimes arising from their development of a large tract of wetland in southern Mississippi. In a 41 count indictment made public this morning, Robert Lucas, Jr., of Lucedale, Mississippi; his daughter, Robbie Lucas Wrigley of Ocean Springs, Mississippi; and M. E. Thompson, Jr., of D’Iberville, Mississippi, were charged with having violated the Clean Water Act in having developed wetlands in a 2600 acre subdivision on property in Vancleave, Mississippi, known as Big Hill Acres. U.S. ANNOUNCES LARGEST PENALTY EVER AWARDED AGAINST A PUBLIC WATER SYSTEM IN MONTEREY COUNTY, CALIFORNIA (04-367)
WASHINGTON, D.C. - The Justice Department and the U.S. Environmental Protection Agency today announced that Judge Jeremy Fogel, of the U.S. District Court for the Northern District of California in San Jose, issued an order on May 20 imposing the largest penalty ever against a public water system. Defendants Alisal Water Corporation, related companies, and Robert and Patricia Adcock, the individual owners of the systems, were ordered to pay a penalty of $500,000 for violations of the federal Safe Drinking Water Act. WASHINGTON, D.C. - The Department of Justice and the U.S. Environmental Protection Agency, along with the U.S. Attorney’s Office for the District of Delaware and the states of Utah and Tennessee, today announced a Clean Water Act settlement for storm water violations at Wal-Mart store construction sites across the country. Under the terms of the agreement, Wal-Mart has agreed to pay a $3.1 million civil penalty and reduce storm water runoff at its sites by instituting better control measures, thereby setting an industry standard for developers and contractors. Christie, U.S. Attorney for the State of New Jersey, today announced that a Connecticut based shipping company that transports petroleum products to and from various ports in the United States and abroad pleaded guilty today to preparing false documents in an effort to cover up the illegal dumping of thousands of gallons of waste oil and sludge at sea. The company, OMI Corporation, also agreed to pay a $4.2 million fine and serve three years probation. U.S. District Judge Katharine S. Hayden accepted the guilty plea. WASHINGTON, D.C. - Rhodia Inc. (“Rhodia”) pleaded guilty today in federal district court in Missoula, Montana to two felonies, for violating the Resource Conservation and Recovery Act (“RCRA”). The violations took place at Rhodia’s elemental phosphorus manufacturing plant located in Silver Bow County, Montana. Pursuant to a plea agreement subject to approval by the court, Rhodia will be required to pay $18 million in criminal fines and restitution. Martin, United States Attorney for the Northern District of Alabama; and David G. McLeod, EPA’s Resident Agent in Charge, today announced that in a plea agreement entered today before federal District Court Judge Inge Johnson, William Murphy pled guilty to all twenty-eight counts of counterfeiting and pesticide misbranding charges pending against him for having sold mislabeled and adulterated pesticides to municipalities in Alabama and Georgia that they used for mosquito and West Nile Virus control. Today’s plea comes on the day in which Mr. Murphy’s trial was to begin in federal district court in Birmingham. (Read more)
