WASHINGTON, D.C. - The Department of Justice and the U.S. Environmental Protection Agency announced today the filing of a civil action against AgriProcessors, Inc., a meat packaging plant in Postville, Iowa. The complaint, filed in the U.S. District Court for the Northern District of Iowa, alleges that AgriProcessors has committed Clean Water Act violations by failing to comply with pretreatment requirements for its wastewater going into a lagoon treatment system owned by the City of Postville and then discharged into the Yellow River. WASHINGTON, D.C. - The Justice Department and the Environmental Protection Agency today announced they have reached a settlement with Explorer Pipeline Company, in which the company has paid a civil penalty of $3 million for violation of the Clean Water Act as amended by the Oil Pollution Act of 1990. According to the complaint filed simultaneously with a stipulated judgment and dismissal, the violation stemmed from a March 9, 2000 discharge of 13,436 barrels of gasoline containing the fuel additive MTBE from a pipeline owned by Explorer and located near Greenville, Texas. WASHINGTON, D.C. - The Justice Department and the U.S. Environmental Protection Agency (EPA) today announced they have reached a settlement with Chevron Phillips Chemical Company in which the company will pay a $1.8 civil penalty for Clean Air Act violations that led to two explosions and releases of chemicals into the air from a chemical manufacturing plant in Pasadena, Texas in 1999 and 2000. This is the largest civil penalty ever assessed for a case of this type. (Read more)

WASHINGTON, D.C. - The Department of Justice, on behalf of the Departments of Interior and Commerce, and the State of New Jersey, announced today that France Shipmanagement S.A., the operator of the tank vessel Anitra-from which there was an estimated 40,000 gallon oil spill in 1996 into the Delaware Bay off the coast of New Jersey-has agreed to pay the United States and State of New Jersey a combined $1.5 million to resolve allegations that the spill resulted in injury to natural resources. WASHINGTON, D.C. - The Department of Justice (DOJ), U.S. Environmental Protection Agency (EPA), Department of the Interior (DOI), and the State of New Mexico today announced two settlement agreements under which the Burlington Northern and Santa Fe Railway Company (BNSF) will cleanup the AT & SF Albuquerque Superfund Site in Albuquerque, New Mexico and reimburse EPA, DOI and the State of New Mexico for costs incurred in connection with the site. EPA and the state estimate that the cleanup will cost $64 million. Silsby, the U.S. Attorney for the District of Maine, announced today that late yesterday two chief engineers for a freighter pled guilty for their role in concealing the overboard dumping of waste oil from the M/V Kent Navigator and using false log books designed to deceive the U.S. Coast Guard. “Today, the United States filed a notice in the U.S. District Court for the Southern District of West Virginia that would appeal the District Court’s decision in Ohio Valley Environmental Coalition v. Bulen to U.S. Court of Appeals for the Fourth Circuit. The appeal is in response to the District Court’s order enjoining many coal mining projects in southern West Virginia. The court’s ruling invalidated a Clean Water Act permit known as Nationwide Permit 21, or “NWP 21,” under which the U.S. Army Corps of Engineers may authorize surface mining projects to discharge rock, dirt, and other fill material into streams if the discharges will have only minimal adverse effects on the environment. Genesis will spend over $3 million as a result of an oil spill which discharged 336,000 gallons of crude oil near Soso, in Jones County, Mississippi, reaching the Leaf River and making it the largest oil spill in Mississippi since the enactment of the Oil Pollution Act of 1990. SAN FRANCISCO - The Department of Justice and the U.S. Environmental Protection Agency today announced that Phelps Dodge Sierrita, Inc. has agreed to pay $1.4 million for allegedly violating the federal Clean Air Act. The company, OMI Corporation, also agreed to pay a $4.2 million fine and serve three years probation. U.S. District Judge Katharine S. Hayden accepted the guilty plea. WASHINGTON, D.C. - Rhodia Inc. (“Rhodia”) pleaded guilty today in federal district court in Missoula, Montana to two felonies, for violating the Resource Conservation and Recovery Act (“RCRA”). The violations took place at Rhodia’s elemental phosphorus manufacturing plant located in Silver Bow County, Montana. Pursuant to a plea agreement subject to approval by the court, Rhodia will be required to pay $18 million in criminal fines and restitution. Attorney for the Southern District of Indiana today announced that a former vice president of one of the largest producers of printed labels for branded consumer products in the United States was sentenced yesterday to 18 months in jail, 50 hours of community service and ordered to pay a fine of $4000 for making a false statement to the Indiana Department of Environmental Management (IDEM). WASHINGTON, D.C. - Thomas L. Sansonetti, Assistant Attorney General of the Justice Department’s Environment and Natural Resources Division; Alice H. Martin, United States Attorney for the Northern District of Alabama; and David G. McLeod, EPA’s Resident Agent in Charge, today announced that in a plea agreement entered today before federal District Court Judge Inge Johnson, William Murphy pled guilty to all twenty-eight counts of counterfeiting and pesticide misbranding charges pending against him for having sold mislabeled and adulterated pesticides to municipalities in Alabama and Georgia that they used for mosquito and West Nile Virus control. Today’s plea comes on the day in which Mr. Murphy’s trial was to begin in federal district court in Birmingham. (Read more)
