FOIA Electronic Reading Room (ERR)

The Freedom of Information Act (FOIA) requires agencies to make various types of records available for public inspection in electronic form. These records consist of: (1) "final opinions [and] . . . orders" rendered in the adjudication of administrative cases; (2) specific agency policy statements; (3) certain administrative staff manuals; and, (4) as of November 1, 1996, records disclosed in response to a FOIA request that "the agency determines have become or are likely to become the subject of subsequent requests for substantially the same records." Listed below are links that will take you directly to the four categories of information required. Notably, these links are only a portion of the information that is available on the Agency's web site.

The categories of FOIA ERR records are as follows:

  1. Final Opinions/Orders in Adjudicated Cases

  3. Staff Manuals/Instructions to Staff Affecting the Public
  4. Frequently Requested Records

Because the Agency makes a large quantity of information available on its website, the user is encouraged to review the website before filing a FOIA request. The search function found at the top of each web page will assist the user to effectively navigate the website.

PLEASE NOTE:

Personally Identifiable Information (PII) on some of the individuals found in some reading room records has been removed. PII is defined as names, addresses, dates of employment, and any other information that could compromise one's privacy. Any Sensitive Security Information (SSI) found in reading room records has also been removed. SSI is defined in 49 CFR Part 15. Confidential financial data submitted by motor carriers may have also been removed from records concerning the submitting carrier.

Only Reading Room records created on or after November 1, 1996, are required to be made available electronically. For access to any FMCSA reading room records that pre-date November 1, 1996, please contact our FOIA Requester Service Center at (202) 366-2960. If such records exist, the FOIA Requester Service Center can assist with making the records available at the following location:
