Rule and Implementation Information for Commercial/Industrial Solid Waste Incinerators
Note: On July 30, 2007 the Court of Appeals for the District of Columbia Circuit issued its mandate in NRDC v. EPA, vacating and remanding EPA's CISWI Definitions Rule and the Boilers Rule. View the Court Mandate Vacating the CISWI Definitions Rule and Boiler MACT in Adobe Acrobat format.
EPA currently plans to propose a response to the vacatur on July 15, 2009. The response will include revised standards and definitions for CISWI units.
While the court vacated the CISWI Definitions Rule, the CISWI rule, as promulgated in December 2000, is still in place. Likewise, the Federal plan, as promulgated in October 2003, is still in place.
