The program aims to facilitate US industrial competitiveness in strategic international trade while preventing sensitive goods from falling into dangerous hands. The program does so by administering exports of certain dual-use commodities and enforcing export control, anti-boycott and certain other public safety laws.

PERFORMING
Moderately Effective

In general, a program rated Moderately Effective has set ambitious goals and is well-managed. Moderately Effective programs likely need to improve their efficiency or address other problems in the programs' design or management in order to achieve better results.
  • The program's purpose, design, and management are strong, however it would benefit from an updated, reauthorized Export Administration Act. A new act would clarify some outdated control requirements, increase penalties for violations, and specify interagency licensing processes.
  • During the 2005 PART, OMB stressed the need for BIS to review their performance goals. In late 2005, BIS revised its Goals and Measures . OMB approved this revision and requested BIS develop a long-term measure related to non-proliferation. BIS included measures in the FY 2007 Game Plan to develop long-term measures related to the effectiveness of the dual-use export control program.

We are taking the following actions to improve the performance of the program:

  • Working to ensure passage of an updated reauthorized Export Administration Act.
  • Two long-term metrics have been developed that measure if foreign users and American companies are properly safeguarding exports of sensitive technologies.
