The following summaries provide information on the date that HOME waivers were granted and denied, the State or Local Field Office making the request, the situation which gave rise to the need for a program waiver, and the regulatory citation. 10/1/96 CO Waiver granted permitting the North Dakota Housing Finance Agency to use FHA Single Family Minimum Property Requirements as a single standard for units assisted through both HOME and the FHA mortgage insurance program. The State sought to avoid duplication of effort, increased paperwork and higher costs to the homebuyer. (State of North Dakota) 92.251
10/16/96 OR Waiver granted permitting the State to count as match the present discounted cash value of Title I insured below-market-rate loans used with the State’s home improvement program. (State of Idaho) 92.220(a)(1)(ii)(B) 92.220(a)(1)(iii)(B)
10/17/96 GA Waiver granted to the State through the Georgia Housing and Finance Agency, authorizing the use of FHA Single Family Minimum Property Requirement standards and/or Fannie Mae Appraisal Standards in place of the Housing Quality Standards required for HOME-assisted units under 92.251. The State indicated that the costs associated with the HQS increase the purchase costs for prospective homebuyers.(State of Georgia) 92.251
10/31/96 CA A waiver of the three-year qualification period requirement under the Interim HOME Rule (92.101(c)) was granted for the Western Nevada HOME Consortium, permitting a newly configured unit of general local government to be approved as a consortium by HUD for FY 97, increasing its overall chances of receiving a HOME Program formula allocation. (Carson, NV/Western Nevada HOME Consortium) 92.101(c)
12/30/96 CA Waiver of 24-month commitment deadline for supplemental emergency HOME funding under 92.4 of the HOME Interim Rule. The City’s nonprofit partner for this particular project had difficulty securing the property, finding additional financing, and making sufficient downpayments for options. City housing staff had also experienced significant turnover. Both factors combined to delay a pair of projects that would have otherwise been completed in a timely manner.(City of Santa Monica) 92.4
12/30/96 CA Waiver of definition of “reconstruction” under 92.2. Emergency HOME funds were needed to demolish a 25-unit structure for health and safety reasons. The structure was to be rebuilt, but due to the demolition and also to recent changes in local zoning requirements, it was not possible for the City to adhere to the Rule’s definition of reconstruction.(City of Los Angeles) 92.2
