Gregory A. White, United States Attorney for the Northern District of Ohio, announced that 5 defendants were sentenced by Judge Christopher Boyko on November 20 and 21 for their roles in public corruption offenses. All 5 defendants pled guilty on August 23, 2006.

Todd Dilley, age 45, of 3806 SR 42, Lexington, OH, was sentenced to 24 months imprisonment, followed by 2 years of supervised release. He was also ordered to pay a $7,500 fine and $69,855.21 in restitution to the City of Mansfield jointly and severally with co-Defendants Carl Michael Dilley and Thomas Yugovich. Todd Dilley was previously employed by the City of Mansfield as the Operations Supervisor in the Sewer Department. Todd Dilley and Carl Michael Dilley admitted that they conspired with Brian Long to commit mail fraud by unjustly enriching themselves and defrauding the City of Mansfield. Long previously pled guilty in the Richland County Court of Common Pleas to one count of felony theft. They improperly induced the City of Mansfield to pay an outside company for products, when in fact, no products were ever delivered. Todd Dilley and Thomas Yugovich also admitted conspiring to obstruct, delay, and affect commerce by Todd Dilley obtaining property from Yugovich with Yugovich's consent, under color of official right. Yugovich was a salesman who sold products to the City of Mansfield on behalf of T&L Supply, Dyna Systems, Xergon, and Partsmaster. Todd Dilley and Yugovich admitted that Yugovich agreed to provide payments to Dilley in return for Dilley's assistance in obtaining sales business for Yugovich. Todd Dilley also pled guilty to mail fraud for contracting to purchase several items from a Lexington, Ohio company on behalf of the City of Mansfield, making arrangements for the City of Mansfield to pay for these items, but retaining these items for himself.

Edward Volz, age 53, of 3501 Lindsay Rd., Lexington, OH, was sentenced to 22 months imprisonment, followed by 2 years of supervised release. He was also ordered to pay a $5,000 fine and $33,860.59 in restitution along with co-Defendant Thomas Yugovich and Brian Shook. Volz was employed as the Supervisor in the Street / Sign and Signal Department. Volz, Shook, and Yugovich admitted that Yugovich agreed to provide $200 payments to Volz and Shook in return for every $1,000 in sales business they provided to Yugovich on behalf of the City of Mansfield.

Thomas Yugovich, age 52, of 2700 Lakecrest Drive, Mansfield, OH, was sentenced to 15 months imprisonment, followed by 2 years of supervised release. He was also ordered to pay a $3,000 fine and $41,360.59 in restitution to the City of Mansfield, jointly and severally with his co-Defendants.

Carl Michael Dilley, age 51, of 449 Vanderbilt Rd., Mansfield, was sentenced to 4 months imprisonment, followed by 2 years of supervised release including 4 months of home confinement for conspiring to violate the federal mail fraud statute. He was also ordered to pay a $5,000 fine and $62,355.21 in restitution along with co-Defendant Todd Dilley. Carl Michael Dilley was previously employed by the City of Mansfield as a Supervisor in the Maintenance Department.

Edward LeMaster, age 46, of 7394 SR 97, Mansfield, OH, was sentenced to 4 months imprisonment, followed by 2 years of supervised release including 4 months of home confinement for conspiring to violate the federal mail fraud statute. He was also ordered to pay $10,852.40 in restitution to the City of Mansfield. LeMaster was employed by the City of Mansfield as a Supervisor in the Water Treatment Department. LeMaster admitted that he conspired with Brian Long to commit mail fraud by unjustly enriching themselves and defrauding the City of Mansfield. They improperly induced the City of Mansfield to pay an outside company for products, when in fact, no products were ever delivered.

City of Mansfield Mayor Lydia J. Reid and Law Director David L. Remy both addressed the Court at the time of sentencing to describe the impact these offenses had on the City of Mansfield.

Brian Shook, age 42, of 4531 SR 181, Mansfield, OH, was charged in a related case with conspiring to obstruct, delay, and affect commerce by obtaining property from Thomas Yugovich with Yugovich's consent, under color of official right. Shook was employed as a Foreman in the City of Mansfield Sign and Signal Department. Shook pled guilty on September 20, 2006, and his sentencing is scheduled for December 13, 2006, at 11 a.m. before Judge Boyko.

This case was prosecuted by Assistant United States Attorney Matthew B. Kall following investigation by the Mansfield office of the Federal Bureau of Investigation, the Richland County Prosecutor’s Office, and the Mansfield Police Department.
